Civil Law (Amendment) Bill

An Act to amend the Civil Law Ordinance (Chapter 24 of the Revised Edition).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title
1.  This Act may be cited as the Civil Law (Amendment) Act, 1968.
Amendment of section 12
2.—(1)  Section 12 of the Civil Law Ordinance is hereby amended —
(a)by substituting a colon for the full-stop appearing at the end of subsection (3) thereof;
(b)by inserting immediately thereafter the following new proviso: —
Provided further that in assessing such damages there shall also not be taken into account —
(a)any sum payable as a result of the death under section 12 of the Central Provident Fund Ordinance (Cap. 150); or
(b)any pension or gratuity, which has been, or will, or may be, paid as a result of the death.”; and
(c)by inserting immediately after the definition of “parent” appearing in subsection (11) thereof the following new definition: —
“ “pension” includes a return of contributions and any payment of a lump sum in respect of a person’s employment;”.
(2)  This section shall not apply in relation to an action instituted before the date of the coming into operation of this Act.
