Control of Manufacture (Amendment) Bill

An Act to amend the Control of Manufacture Ordinance, 1959 (No. 14 of 1959).

Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —

Short title and commencement

1. This Act may be cited as the Control of Manufacture (Amendment) Act, 1969, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Amendment of section 5

2. Section 5 of the Control of Manufacture Ordinance, 1959 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —

(a)	by inserting immediately after the words “class of goods” appearing in the tenth line of the proviso to subsection (2) thereof the words “within six months of such specification”;
(b)	by deleting subsections (3), (4) and (5) thereof;
(c)	by deleting the words “or by any undertaking given by the Registrar under subsection (3) of this section in respect of any goods or class of goods” appearing in the third, fourth and fifth lines of subsection (6) thereof; and
(d)	by re-numbering subsections (6), (7) and (8) thereof as subsections (3), (4) and (5) respectively.

Amendment of section 6

3. Section 6 of the Ordinance is hereby amended —

(a)

by deleting subsection (1) thereof and substituting therefor the following: —

“(1) Where it appears to the Registrar that —

(a)	any registration was effected as a result of a misrepresentation of facts;
(b)	any condition of registration has been contravened by a Registered Manufacturer; or
(c)	a Registered Manufacturer has for a continuous period of not less than three months ceased to manufacture goods in respect of which he has been registered,

the Registrar may, after notice to the Registered Manufacturer and after such enquiry as he thinks fit, revoke the registration.”; and

(b)

by inserting immediately after subsection (4) thereof the following subsection: —

“(5) For the purpose of paragraph (c) of subsection (1) of this section, the Registrar may by notice in writing require a Registered Manufacturer to manufacture such minimum quantity of goods as the Registrar may determine and a Registered Manufacturer who fails to comply with any such notice shall be deemed to have ceased to manufacture those goods.”.

Amendment of section 8

4. Section 8 of the Ordinance is hereby amended —

(a)

by deleting the word “ten” appearing in the sixth line of subsection (1) thereof and substituting therefor the word “fifty”;

(b)

by deleting the words “five thousand dollars and to a fine not exceeding five hundred” appearing in the fourth and fifth lines of subsection (2) thereof and substituting therefor the words “ten thousand dollars and to a fine not exceeding one thousand”;

(c)

by deleting the words “five hundred” appearing in the last line of subsection (3) thereof and substituting therefor the words “one thousand”; and

(d)

by inserting immediately after subsection (4) thereof the following subsection: —

“(5) The Registrar may, in his discretion, compound any offence under this Ordinance by accepting from a person reasonably suspected of having committed such offence a sum of money not exceeding one thousand dollars.”.

New section 11A

5. The Ordinance is hereby amended by inserting immediately after section 11 thereof the following section: —

“Imposition of duty

11A.—(1) The Minister may, by order, impose an annual duty for the manufacture of goods to be levied on Registered Manufacturers at such rate as the Minister may determine.

(2) The Minister may in such order prescribe different rates of duties for different categories of goods.

(3) All duties due and payable by a Registered Manufacturer shall be recoverable as a debt due to the Government.”.

Repeal and re-enactment of section 13

6. Section 13 of the Ordinance is hereby repealed and the following substituted therefor: —

“Power of the Minister to exempt and to impose restriction on manufacture of goods

13.—(1) The Minister may exempt any person from the provisions of this Ordinance.

(2) The Minister may, where he considers it in the interest of the public to do so, by order served on any Registered Manufacturer or published in the Gazette, fix the maximum amount of goods which may, from time to time, be manufactured by such Registered Manufacturer; and any Registered Manufacturer who contravenes or fails to comply with any such order shall for the purposes of this Ordinance be deemed to have contravened a condition of registration.”.

Repeal and re-enactment of section 14

7. Section 14 of the Ordinance is hereby repealed and the following substituted therefor: —

“Rules and orders to be presented to Parliament

14. All rules and orders made under section 11, 11A or 12 of this Ordinance shall be published in the Gazette and shall be presented to Parliament as soon as may be after publication.”.
