Road Traffic (Amendment No. 3) Bill

An Act to amend the Road Traffic Act (Chapter 92 of the Revised Edition).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title and commencement
1.  This Act may be cited as the Road Traffic (Amendment No. 3) Act, 1981.
Amendment of section 2
2.  Section 2 of the Road Traffic Act (referred to in this Act as the principal Act) is amended by inserting, immediately after the definition of “goods vehicle” in subsection (1), the following definition: —
“ “Minister” means —
(a)except as provided in paragraph (b), the Minister for Communications;
(b)for the purposes of the whole of Parts II and IIA and sections 25(2), 25(3), 33, 33A, 33B, 65, 66, 66A, 67, 68, 72, 74, 83, 84(7), 84A and 85(2) of this Act, the Minister for Home Affairs.”.
New section 66A
3.  The principal Act is amended by inserting, immediately after section 66, the following section: —
Traffic regulation on special roads
66A.—(1)  The Minister may make rules to prohibit or restrict the use of any special road by any traffic or class of traffic subject to such conditions or exceptions as may be prescribed.
(2)  Rules made under this section may make provision with respect to special roads generally, or may make different provision with respect to special roads provided for the use of different classes of traffic, or may make provision with respect to any particular special road.
(3)  Rules made under this section may, in particular —
(a)regulate the manner in which and the conditions subject to which special roads may be used by traffic of any class;
(b)authorise, or enable a Deputy Commissioner of Police to authorise, the use of special roads, on any occasion or in an emergency or for the purpose of crossing, or for the purpose of securing access to premises abutting on or adjacent to the special roads by any traffic;
(c)relax, or enable a Deputy Commissioner of Police to relax, any prohibition or restriction imposed by the rules.
(4)  For the purposes of this section —
“special road” means any road specified in the rules made under this section to be a special road, and includes any part of a special road;
“traffic” includes pedestrians;
“use”, in relation to a road, includes crossing.”.
Amendment of section 74
4.  Section 74 of the principal Act is amended by deleting the words “or the Registrar” in subsections (2) and (3).
Amendment of section 88
5.  Section 88 of the principal Act is amended by inserting, immediately after the word “Registrar” at the end and in the marginal note, the words “and a Deputy Commissioner of Police”.
Amendment of section 89
6.  Section 89 of the principal Act is amended —
(a)by inserting, immediately after the word “Registrar” in the ninth line of subsection (2) and in the third line of subsection (5), the words “or a Deputy Commissioner of Police, as the case may be,”; and
(b)by inserting, immediately after the word “Registrar” in the last line of subsection (2) and in the sixth line of subsection (5), the words “or the Deputy Commissioner of Police, as the case may be,”.
Miscellaneous amendments
7.  The principal Act is amended —
(a)by deleting the words “the Registrar” wherever it appears in the following provisions and substituting in each case the words “a Deputy Commissioner of Police”: —
Sections 14(2), 14(4), 14(5), 14(10), 15(1), 15(2), 15(4)(b), 16(2), 16(3), 19, 20(1), 23 (and marginal note), 23A(1), 23A(4), 23A(5) (and marginal note), 23B(1), 23B(2), 23B(4), 23C(1), 23C(2), 23C(3), 23D(h), 23G(1), 23H(1), 23H(2), 23H(4), 23I(1), 23I(2), 23I(3), 23I(5), 23I(8), 23J(1), 23K, 23L, 23M, 23N, 23O and 23P; and
(b)by inserting, immediately before the word “Minister” wherever it appears in sections 90 and 92, the word “appropriate”.
