Road Traffic (Amendment) Bill

An Act to amend the Road Traffic Ordinance, 1961 (No. 26 of 1961).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title and commencement
1.—(1)  This Act may be cited as the Road Traffic (Amendment) Act, 1968, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.
(2)  The Minister may appoint different dates for the coming into operation of different provisions of this Act.
Amendment of section 2
2.  Section 2 of the Road Traffic Ordinance, 1961 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended by inserting, immediately after the figure “15” appearing in the definition of “driving licence” therein, the expresson “, 15A”.
Amendment of section 13
3.  Section 13 of the Ordinance is hereby amended —
(a)by deleting subsection (3) thereof; and
(b)by deleting the word “date” appearing in the fourth line of subsection (8) thereof and substituting therefor the words “first day of the month”.
Amendment of section 14
4.  Subsection (1) of section 14 of the Ordinance is hereby amended by deleting the words “satisfies the Registrar that he has at some time passed” appearing in the second and third lines thereof and substituting therefor the words “undergoes and passes”.
New section 15A
5.  The Ordinance is hereby amended by inserting, immediately after section 15 thereof, the following new section: —
Renewal of driving licences
15A.—(1)  Subject to subsection (2) of this section and to any rules made under section 46 of this Ordinance, the Registrar, or any person authorised by him, may, on application in the prescribed form and upon payment of the prescribed fee, renew a driving licence for a period of either one year or three years with effect from the date of its expiry, as the applicant may elect at the time of making application for such renewal.
(2)  The Registrar shall not renew a driving licence which has ceased to be effective for a continuous period of more than three years.”.
Amendment of section 19
6.  Subsection (1) of section 19 of the Ordinance is hereby deleted and the following substituted therefor: —
(1)  Any court before which a person is convicted of any criminal offence in connection with the driving of a motor vehicle may, in any case except where otherwise expressly provided by this Part of this Ordinance, and shall, where so required by this Part of this Ordinance, order him to be disqualified for holding or obtaining a driving licence for life or for such period as the court thinks fit:
Provided that if the court thinks fit, any disqualification imposed under this section may be limited to the driving of a motor vehicle of the same class or description as the motor vehicle in relation to which the offence was committed.”.
Repeal and re-enactment of section 21
7.  Section 21 of the Ordinance is hereby repealed and the following substituted therefor: —
Recording of particulars of convictions or disqualification by Registrar
21.—(1)  Where a person is convicted of an offence under sections 23, 24, 25, 26, 27, 28 and 42 of this Ordinance or is disqualified by any court for holding or obtaining a driving licence, the court shall send notice of the conviction or order of disqualification to the Registrar who shall thereupon cause particulars of such conviction or disqualification to be recorded and maintained for a period not exceeding three years from the date of the conviction or expiry of disqualification, as the case may be.
(2)  In any proceedings in any court a certificate, purporting to be signed by the Registrar or any officer authorized by him, relating to the particulars of any conviction or disqualification recorded and maintained under subsection (1) of this section shall be prima facie evidence of such conviction or disqualification.”.
Amendment of section 41
8.  Section 41 of the Ordinance is hereby amended —
(a)by inserting, immediately after the words “police officer” appearing in the fifth line of subsection (1) thereof, the words “or the Registrar or any officer authorized in writing in that behalf by the Registrar on production of his authority”; and
(b)by inserting, immediately after the words “Deputy Commissioner of Police” wherever they appear in subsections (1), (2), (3) and (4) thereof, the words “or the Registrar”.
Amendment of section 46
9.  Section 46 of the Ordinance is hereby amended by deleting the words “or endorsed” appearing in the fourth line of paragraph (z) thereof.
Amendment of section 77
10.  Subsection (2) of section 77 of the Ordinance is hereby amended —
(a)by deleting the expression “; or” appearing at the end of paragraph (f) thereof and substituting therefor a comma; and
(b)by deleting paragraph (g) thereof.
Repeal of certain provisions
11.  The following provisions of the Ordinance are hereby repealed: —
Sections 23 (6), 24 (2), 26 (4), 27 (2), 79 (2) and 83 (6).
