Public Utilities (Amendment) Bill

An Act to amend the Public Utilities Ordinance, 1963 (No. 1 of 1963).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title and commencement
1.  This Act may be cited as the Public Utilities (Amendment) Act, 1968, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.
Amendment of section 5
2.  Section 5 of the Public Utilities Ordinance, 1963 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —
(a)by deleting subsection (1) thereof and substituting therefor the following: —
(1)  The Board shall consist of —
(a)a Chairman, to be appointed by the Minister;
(b)ten other members who shall not be public officers, to be appointed by the Minister; and
(c)one public officer, to be appointed by the Minister.”;
(b)by deleting the words “Yang di-Pertuan Negara” wherever they appear in subsections (2), (3), (4), (5), (6) and (9) thereof and substituting therefor in each case the word “Minister”.
Amendment of section 9
3.  Section 9 of the Ordinance is hereby amended by deleting the words “Yang di-Pertuan Negara” appearing therein and substituting therefor the word “Minister”.
Amendment of section 10
4.  Subsection (1) of section 10 of the Ordinance is hereby amended by deleting the word “five” appearing therein and substituting therefor the word “seven”.
Amendment of section 15
5.  Subsection (2) of section 15 of the Ordinance is hereby amended —
(a)by deleting the word “and” appearing at the end of paragraph (i) thereof;
(b)by inserting immediately after paragraph (i) thereof the following new paragraphs: —
(j)by resolution thereof, and by mutual agreement act as agent for the Government or any department thereof or any statutory body in the collection of fees for services performed or rendered by the Government or any department thereof or any statutory body;
(k)grant or guarantee loans to any employee of the Board for the purchase of a house, land or flat for the use or occupation of such employee or for the use or occupation of his family;
(l)grant loans to employees of the Board for any purposes specifically approved by the Board as are likely to increase the efficiency of such employees; and”; and
(c)by re-lettering paragraph (j) thereof as paragraph (m).
Amendment of section 22
6.  Section 22 of the Ordinance is hereby amended —
(a)by deleting the marginal note thereto;
(b)by inserting immediately before subsection (1) thereof, the following new subsections: —
Appointment of committees of the Board, and delegation of its powers
(1)  The Board may appoint such committees consisting of such number of members of the Board as it thinks fit for any purposes which, in the opinion of the Board, would be better regulated and managed by means of such committees.
(2)  The Board may, subject to such conditions or restrictions as it thinks fit, delegate to such committees all or any of the functions required to be performed by the Board under this Ordinance, except the power to make regulations, prescribe or levy dues and rates and borrow money.”; and
(c)by renumbering existing subsections (1) and (2) thereof as subsections (3) and (4) respectively.
