Regulation of Employment (Amendment) Bill

An Act to amend the Regulation of Employment Act (Chapter 127 of the Revised Edition).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title and commencement
1.  This Act may be cited as the Regulation of Employment (Amendment) Act, 1975, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.
Amendment of section 8
2.  Section 8 of the Regulation of Employment Act (hereinafter in this Act referred to as “the principal Act”) is hereby amended by inserting immediately after subsection (2) thereof the following new subsection: —
(3)  No employer or contractor shall employ an employee or contract worker, as the case may be, otherwise than in accordance with the conditions contained in the work permit.”.
New section 8A
3.  The principal Act is hereby amended by inserting immediately after section 8 thereof the following new section: —
Self-employed persons carrying on certain occupations to apply for work permits
8A.  The Minister may from time to time by notification in the Gazette prohibit any person, not being employed under a contract of service, from engaging in any trade, calling, occupation, or other activity for the purposes of gain that is specified in the notification unless he has obtained a work permit for that purpose.”.
Amendment of section 11
4.  Subsection (2) of section 11 of the principal Act is hereby amended by inserting immediately after the word “defaced” appearing at the end thereof the words “upon payment of the prescribed fee”.
Amendment of section 14
5.  Subsection (1) of section 14 of the principal Act is hereby amended —
(a)by inserting immediately after the figure “8” appearing in paragraph (e) thereof the expression “or 8A”;
(b)by deleting the comma appearing at the end of paragraph (h) thereof and substituting therefor a semi-colon; and
(c)by inserting immediately after paragraph (h) thereof the following new paragraphs: —
(i)makes any statement or furnishes any information to the Commissioner or an employment officer pursuant to this Act which is false in any material particular or is misleading by reason of the omission of any material particular; or
(j)fails to comply with or observe the conditions contained in the work permit issued to him,”.
New section 14A
6.  The principal Act is hereby amended by inserting immediately after section 14 the following new section: —
Compounding of offences
14A.  The Commissioner may compound any offence under this Act by accepting from the person reasonably suspected of committing the offence a sum not exceeding one hundred dollars.”.
Amendment of section 16
7.  Section 16 of the principal Act is hereby amended by deleting subsection (1) thereof and substituting therefor the following: —
(1)  The provisions of subsections (1) and (3) of section 4, subsection (2) of section 8 and section 8A shall not apply to citizens of Singapore.”.
