Parking Places (Amendment) Bill

An Act to amend the Parking Places Ordinance, 1963 (No. 17 of 1963).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows: —
Short title and commencement
1.  This Act may be cited as the Parking Places (Amendment) Act, 1970, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.
Amendment of section 2
2.  Section 2 of the Parking Places Ordinance, 1963 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —
(a)by inserting immediately before the definition of “parking place” appearing therein the following new definition: —
“ “park” with its grammatical variations means, in respect of a vehicle, to bring such vehicle to a stationary position and cause it to wait for any purpose;”; and
(b)by inserting immediately after the definition of “parking place” appearing therein the following new definition: —
“ “Superintendent” means the Superintendent of Car Parks appointed by the Minister under the provisions of section 4A of this Ordinance and includes a person appointed to act as Superintendent;”.
New section 3A
3.  The Ordinance is hereby amended by inserting immediately after section 3 thereof the following new section: —
Use of property as a parking place
3A.  The Minister may, by order published in the Gazette, authorise the use as a parking place of any land or premises with respect to which an arrangement has been made between the Superintendent and the owner or the occupier thereof for the use of such land or premises as a parking place.”.
Amendment of section 4
4.  Section 4 of the Ordinance is hereby amended by deleting the expression “and may appoint, with or without remuneration, such officers and servants as may be necessary for the superintending of parking places” appearing in the fourth, fifth and sixth lines thereof.
New section 4A
5.  The Ordinance is hereby amended by inserting immediately after section 4 thereof the following new section: —
Appointment of officers
4A.  The Minister may appoint, with or without remuneration, a Superintendent of Car Parks and such other officers and servants as may be necessary for the superintending of parking places.”.
Amendment of section 5
6.  Section 5 of the Ordinance is hereby amended by inserting immediately after the word “road” appearing in the third line thereof the words “or any other place”.
Repeal and re-enactment of section 6
7.  Section 6 of the Ordinance is hereby repealed and the following substituted therefor: —
Rules
6.—(1)  The Minister may make rules —
(a)as to the use of parking places and in particular as to the vehicles or class of vehicles which are entitled to use any such parking places and as to conditions upon and the times at which such parking places may be used; and
(b)for the control, regulation and supervision by registration, licensing or otherwise of garages and places kept or used for the housing or parking of vehicles except garages or places used in connection with private dwelling-houses for housing or parking vehicles kept for private use only.
(2)  Such rules may —
(a)prescribe fees to be paid for the grant or renewal of any licence;
(b)prescribe the time within which charges prescribed by section 7 of this Ordinance shall be paid and prescribe surcharges to be paid by any person who failed to pay the charges prescribed by the said section within such prescribed time; and
(c)provide that a contravention thereof shall be punishable by a fine not exceeding two hundred and fifty dollars.”.
Amendment of section 7
8.  Section 7 of the Ordinance is hereby amended by deleting the words “and a copy of every such order shall be exhibited on or near any parking place to which the order relates” appearing in the fifth, sixth and seventh lines thereof.
New sections 10A and 10B
9.  The Ordinance is hereby amended by inserting immediately after section 10 thereof the following new sections: —
Power to compound offences
10A.  The Superintendent or any officer specially empowered by the Superintendent to act in that behalf may accept from any person who is reasonably suspected of having committed an offence under this Ordinance a sum of money not exceeding one-fifth of the maximum fine provided for such offence by way of composition for the offence which may have been committed.
Service of notice
10B.—(1)  Every notice, order or document required or authorised by this Ordinance or any rules made thereunder to be served on any person may be served —
(a)by delivering the same to such person or by delivering the same at the last known place of abode of such person to some adult member or servant of his family;
(b)by leaving the same at the usual or last known place of abode or business of such person in a cover addressed to such person; or
(c)forwarding the same by post in a prepaid letter addressed to such person at his usual or last known place of abode or business.
(2)  Any notice, order or document required to be served on any person shall, if it is served in accordance with subsection (1) of this section, be deemed to be service on that person.”.
