Citation

1. These Regulations may be cited as the Building Control (Accredited Checkers) Regulations.

Accreditation Selection Panel.

2.—(1) For the purposes of section 16 (4) of the Act, the Building Authority may appoint a committee to be known as an Accreditation Selection Panel comprising a Chairman and 6 other members to assist the Building Authority in considering applications for registration as accredited checkers under the Act.

(2) Without prejudice to paragraph (1), the Accreditation Selection Panel may —

(a)	interview any applicant for registration as an accredited checker with a view to determining whether the applicant has such proper and recognised training and practical experience in the design or construction of buildings as will enable him efficiently to perform the duties of an accredited checker; and
(b)	make recommendations to the Building Authority as to the applicants who are deserving of registration as accredited checkers.

(3) The Chairman of the Accreditation Selection Panel shall preside at all meetings of the Accreditation Selection Panel.

(4) The Accreditation Selection Panel shall meet at such times and places as the Building Authority may determine.

(5) Subject to this regulation, the Accreditation Selection Panel may regulate its own procedure.

Qualifications for registration as accredited checkers.

3. No person shall be registered under the Act as an accredited checker unless he can satisfy the Building Authority that —

(a)	he possesses such qualifications as will entitle him to be registered as a professional engineer under the Professional Engineers Act [Cap. 253];
(b)	he is a professional engineer registered under the Professional Engineers Act in the civil or structural engineering discipline;
(c)	he has had, after such registration as a professional engineer, practical experience in the design or construction of buildings in Singapore at a professional level for a period of not less than 10 years; and
(d)	by virtue of his ability, standing in the profession or special knowledge or practical experience in civil or structural engineering he is deserving of such distinction.

Application for registration.

4. Every application for registration as an accredited checker under the Act shall —

(a)

be in Form 1 set out in the Schedule;

(b)

be accompanied by true copies of any documentary evidence showing that he possesses the qualifications and the practical experience referred to in regulation 3;

(c)

be accompanied by two recent certificates as to his good character;

(d)

be accompanied by a recent certificate issued by the Registrar of the Professional Engineers Board that at the date of the certificate —

(i)	no disciplinary proceedings are pending or contemplated against the applicant; and
(ii)	the applicant’s professional conduct is not and has never been under investigation by the Board.

Duplicate certificate of accreditation.

5. A fee of $10 shall be payable in respect of any duplicate certificate of accreditation issued by the Building Authority.

Duties of accredited checkers.

6.—(1) It shall be the duty of an accredited checker to —

(a)	evaluate, analyse and review the structural design in the plans of any building works and perform such original calculations with a view to determining the adequacy of the key structural elements of the building to be erected or affected by building works carried out in accordance with those plans; and
(b)	verify that the key structural elements designed are consistent with the layout shown in the architectural plans and any amendment thereto.

(2) Without prejudice to paragraph (1), an accredited checker shall in carrying out his duties in relation to any plans of building works —

(a)	determine and use the Code of Practice adopted in the preparation of the structural design in the plans of building works;
(b)	check the design loading and, where applicable, wind loading;
(c)	check the standards and specifications of materials to be used in the building works;
(d)	ascertain the structural design concept used and identify the key structural elements;
(e)	analyse all key structural elements and the foundation system of the building to be erected or affected by building works carried out in accordance with those plans;
(f)	determine the stability of the structural frame;
(g)	check structural detailing; and
(h)	determine the adequacy of other aspects of the design which are peculiar to the building to be erected or affected by the building works and which are essential to the structural integrity of the building.

(3) It shall be the duty of the accredited checker to notify the Building Authority of any contravention or non-compliance with the provisions of the Act or any regulations made thereunder in connection with the structural design of any plans of building works:

Provided that nothing in this regulation shall impose any such duty on an accredited checker in respect of any such contravention or non-compliance which he did not know and could not reasonably have discovered.

Certificate of adequacy of key structural elements.

7. An accredited checker shall, without delay after performing his duty in relation to any plans of building works, prepare and submit to the person for whom the building works are to be or are being carried out —

(a)	a certificate in Form 2 set out in the Schedule:
(b)	an evaluation report including the analysis and calculations performed by the accredited checker; and
(c)	a declaration that he has no professional or financial interest in the building works.

Appeals to Minister.

8. Any appeal under section 16 (8) of the Act shall —

(a)	be in writing and addressed to the Minister;
(b)	state the decision of the Building Authority in respect of which the appeal is brought;
(c)	specify the grounds on which the appeal is brought; and
(d)	be accompanied by such documentary evidence as the Minister considers necessary.
