Miscellaneous Offences (Public Order and Nuisance) (Festival Auction Assembly) Rules

Citation
1.  These Rules may be cited as the Miscellaneous Offences (Public Order and Nuisance) (Festival Auction Assembly) Rules.
Application
2.  These Rules shall apply to any assembly of 5 or more persons in any public road, public place or place of public resort which is organised for the purpose of an auction held in conjunction with any celebration of the Seventh Month Festival of the Chinese Lunar calendar (referred to in these Rules as a festival auction assembly).
Consent of owner or occupier
3.  No person shall organise, or assist in the organising of, any festival auction assembly unless the previous consent of the owner or occupier of the land on which the festival auction assembly is to be held has been obtained.
Presence of organiser
4.  A person who organises a festival auction assembly shall be present, or shall arrange for his agent to be present, at all times during the festival auction assembly at the place where the assembly is held.
Conditions
5.  A person who organises or assists in the organising of any festival auction assembly shall ensure that —
(a)the festival auction assembly ends not later than 10.30 p.m. each night;
(b)not more than 2 loudspeakers are used for the purposes of the festival auction assembly;
(c)the loudspeakers used for the purposes of the festival auction assembly are positioned so that the loudspeakers face the audience and are inclined downwards; and
(d)any stage, structure, shed or fixture used for the purposes of the festival auction assembly is not —
(i)installed, erected or constructed; or
(ii)removed or dismantled,
between the hours of 11 p.m. and 7 a.m.
Penalty
6.  Any person who contravenes rule 3, 4 or 5 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding one month or to both.
Powers of dispersal
7.  Any police officer may order the dispersal of any festival auction assembly if the assembly is not organised in accordance with these Rules or if a breach of the peace is likely to occur.
