Town Council of Potong Pasir (Prohibiting and Regulating of Parking of Vehicles) By-laws

Citation

1. These By-laws may be cited as the Town Council of Potong Pasir (Prohibiting and Regulating of Parking of Vehicles) By-laws.

Definitions

2.—(1) In these By-laws, unless the context otherwise requires —

“parking” means to bring a vehicle to a stationary position and cause it to remain there for any purpose;

“parking place” has the same meaning as in the Parking Places Act (Cap. 214);

“vehicle” means any vehicle, whether mechanically propelled or not, intended or adapted for use on the road.

(2) Nothing in these By-laws shall prohibit officers, employees or agents of the Town Council or any person authorised by the Town Council from doing any act that is reasonably necessary or expedient in the enforcement of these By-laws.

No parking or driving of vehicles

3. No person shall —

(a)	park any vehicle on common property or in any open space within the Town except in a parking place; or
(b)	drive or ride any vehicle on common property or in any open space within the Town.

Power to detain or remove vehicles

4.—(1) Where a vehicle is parked on common property in contravention of these By-laws, the Town Council or its officers, employees or agents may detain the vehicle by any means.

(2) The Town Council shall give a notice in writing of the detention to the owner or person having lawful possession of the vehicle.

(3) The owner or person having lawful possession of the vehicle detained shall, within 3 days of the notice served on him by the Town Council, pay all expenses incurred by the Town Council as a result of the detention.

(4) The vehicle so detained shall remain at the risk of the owner or person having lawful possession of the vehicle until all expenses have been paid.

(5) Where any vehicle so detained by the Town Council is not claimed by the owner or person having lawful possession of the vehicle within 7 days of the notice served on him, the Town Council or its officers, employees or agents may remove the vehicle to a place of safety.

(6) The Town Council shall give a notice in writing of the removal to the owner or person having lawful possession of the vehicle.

(7) The owner or person having lawful possession of the vehicle removed shall, within 30 days of the notice served on him by the Town Council, pay all expenses incurred by the Town Council as a result of the removal.

(8) The vehicle so removed and kept in the custody of the Town Council shall remain at the risk of the owner or person having lawful possession of the vehicle until all expenses have been paid.

(9) The Town Council or its officers, employees or agents shall not be liable for any damage caused to the vehicle in the course of its detention, removal and whilst in the custody of the Town Council.

Penalty

5. Any person who contravenes or fails to comply with these By-laws shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000.
