(Risk Management)
(Amendment) Regulations 2024
In exercise of the powers conferred by section 65 of the Workplace Safety and Health Act 2006, the Minister for Manpower makes the following Regulations:
Citation and commencement
1.  These Regulations are the Workplace Safety and Health (Risk Management) (Amendment) Regulations 2024 and come into operation on 1 January 2025.
Amendment of regulation 3
2.  In the Workplace Safety and Health (Risk Management) Regulations (Rg 8) (called in these Regulations the principal Regulations), in regulation 3 —
(a)replace paragraph (1) with —
(1)  In every workplace —
(a)the employer, self‑employed person and principal shall conduct a risk assessment in relation to the safety and health risks posed to any person who may be affected by his undertaking in the workplace; and
(b)the platform operator shall conduct a risk assessment in relation to the safety and health risks posed to any of the platform operator’s platform workers at work in the workplace.”; and
(b)in paragraph (2), replace “paragraph (1)” with “paragraph (1)(a) or (b)”.
Amendment of regulation 4
3.  In the principal Regulations, in regulation 4 —
(a)replace paragraph (1) with —
(1)  In every workplace —
(a)the employer, self‑employed person and principal shall take all reasonably practicable steps to eliminate any foreseeable risk to any person who may be affected by his undertaking in the workplace; and
(b)the platform operator shall take all reasonably practicable steps to eliminate any foreseeable risk to any of the platform operator’s platform workers at work in the workplace.”; and
(b)in paragraph (2), replace “paragraph (1)” with “paragraph (1)(a) or (b) (as the case may be)”.
Amendment of regulation 6
4.  In the principal Regulations, in regulation 6 —
(a)in paragraph (1), replace “any person in the workplace who may be exposed to a risk to his safety and health” with “the specified person”; and
(b) after paragraph (2), insert —
(3)  In paragraph (1), the specified person —
(a)in relation to the employer, self‑employed person and principal, is any person; and
(b)in relation to the platform operator, is any platform worker of the platform operator,
in the workplace who may be exposed to a risk to his safety and health.”.
Replacement of regulation 7
5.  In the principal Regulations, replace regulation 7 with —
Review of risk assessment
7.—(1)  In every workplace —
(a)the employer, self‑employed person and principal shall review and, if necessary, revise the risk assessment mentioned in regulation 3(1)(a); and
(b)the platform operator shall review and, if necessary, revise the risk assessment mentioned in regulation 3(1)(b),
at least once every 3 years.
(2)  Despite paragraph (1) —
(a)the employer, self‑employed person and principal shall review and revise the risk assessment mentioned in regulation 3(1)(a); and
(b)the platform operator shall review and revise the risk assessment mentioned in regulation 3(1)(b),
if any of the circumstances specified in paragraph (3) occurs.
(3)  The specified circumstances mentioned in paragraph (2) are —
(a)the occurrence of any bodily injury to any person as a result of exposure to a hazard in the workplace; or
(b)a significant change in work practices or procedures.”.
Amendment of Schedule
6.  In the principal Regulations, in the Schedule —
(a)in Part 1, replace items 1 to 5 with —
1.Offence for contravening regulation 5(1)
(a)the current offence in this item;
(b)an offence under regulation 8(2) for contravening regulation 5(1) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 5(1) as in force immediately before that date
2.Offence for contravening regulation 6(1)
(a)the current offence in this item;
(b)an offence under regulation 8(2) for contravening regulation 6(1) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 6(1) as in force immediately before that date
3.Offence for contravening regulation 6(2)
(a)the current offence in this item;
(b)an offence under regulation 8(2) for contravening regulation 6(2) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 6(2) as in force immediately before that date
4.Offence for contravening regulation 7(1)
(a)the current offence in this item;
(b)an offence under regulation 8(2) for contravening regulation 7(1) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 7(1) as in force immediately before that date
5.Offence for contravening regulation 7(2)
(a)the current offence in this item;
(b)an offence under regulation 8(2) for contravening regulation 7(2) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 7(2) as in force immediately before that date
”; and
(b)in Part 2, replace item 1 with —
1.Offence for contravening regulation 5(2)
(a)the current offence in this item;
(b)an offence under regulation 8(3) for contravening regulation 5(2) as in force immediately before 1 January 2025; or
(c)an offence under regulation 8 as in force immediately before 1 June 2024 for contravening regulation 5(2) as in force immediately before that date
”.
Miscellaneous amendments
7.  In the principal Regulations —
(a)in the following provisions, replace “or principal” with “, principal or platform operator (as the case may be)”:
Regulation 4(2) and (4)
Regulation 5(2); and
(b)in the following provisions, replace “and principal” with “, principal and platform operator”:
Regulation 5(1)
Regulation 6(1) and (2).
