State Lands (Amendment) Rules 2021

In exercise of the powers conferred by section 3 of the State Lands Act, the President makes the following Rules:

Citation and commencement

1. These Rules are the State Lands (Amendment) Rules 2021 and come into operation on 18 February 2021.

Amendment of rule 2

2. Rule 2 of the State Lands Rules (R 1) (called in these Rules the principal Rules) is amended by deleting the definition of “lease” and substituting the following definition:

“ “lease” does not include a tenancy for a term of less than 10 years.”.

Amendment of rule 10

3. Rule 10 of the principal Rules is amended by inserting, immediately after the words “for a term”, the words “not less than 10 years and”.

Amendment of rule 11

4. Rule 11 of the principal Rules is amended by deleting paragraph (1) and substituting the following paragraphs:

“(1) When the sale of State land by public auction or public tender has been authorised, the Collector of Land Revenue must publish a notice of sale in accordance with paragraph (1A) on the Internet website of the agent of the Government through which the sale is to be carried out, as follows:

(a)	Housing and Development Board — https://www.hdb.gov.sg/;
(b)	Jurong Town Corporation — https://jtc.gov.sg/;
(c)	Singapore Land Authority — https://www.sla.gov.sg/;
(d)	Urban Redevelopment Authority — https://www.ura.gov.sg/.

(1A) A notice of sale mentioned in paragraph (1) must describe the land and state —

(a)	in the case of a sale by public auction — the place, date and time of the sale;
(b)	in the case of a sale by public tender — the closing date and time of the public tender; and
(c)	the manner in which the conditions of the sale may be obtained.”.

Amendment of rule 20

5. Rule 20 of the principal Rules is amended by deleting paragraph (1) and substituting the following paragraphs:

“(1) Every licence issued on or after 18 February 2021 must be issued for a period of less than 10 years.

(1A) The Collector of Land Revenue may reissue to the licensee under a previous licence that expires on or after 18 February 2021 another licence for a period of less than 10 years for the same State land.”.

Deletion and substitution of rule 21

6. Rule 21 of the principal Rules is deleted and the following rule substituted therefor:

“Duration of tenancy

21.—(1) Every tenancy granted on or after 18 February 2021 under these Rules must be for a term of less than 10 years.

(2) The Collector of Land Revenue may regrant to the tenant under a previous tenancy that expires on or after 18 February 2021 another tenancy for a term of less than 10 years for the same State land.”.
