(Halal Certificates) (Amendment) Rules 2018

In exercise of the powers conferred by section 88C of the Administration of Muslim Law Act, the Majlis Ugama Islam, Singapura, with the approval of Dr Yaacob Ibrahim, who is charged with the responsibility for the portfolio of the Minister for Culture, Community and Youth as regards Muslim affairs, makes the following Rules:

Citation and commencement

1. These Rules are the Administration of Muslim Law (Halal Certificates) (Amendment) Rules 2018 and come into operation on 1 February 2018.

Deletion and substitution of Schedule

2. The Schedule to the Administration of Muslim Law (Halal Certificates) Rules (R 8) is deleted and the following Schedule substituted therefor:

5.	Halal certificate with a validity period of one year to operate any of the following retail food establishments:

(a)	a restaurant with a total floor area not exceeding 186 square metres

(b)	a restaurant with a total floor area exceeding 186 square metres

(c)	a food or hawker stall, or any stall selling uncooked food, with a total floor area not exceeding 13 square metres

6.	Halal certificate with a validity period of one year to operate —

(a)	a kitchen facility in a preschool

7.	Halal certificate with a validity period of one year to operate the whole or any section of a storage facility or warehouse

8.	Halal certificate with a validity period of 7 days to operate a retail food establishment at any bazaar, fair, trade exposition or other similar activity or event held on premises other than the certified premises, facility or establishment of a halal certificate holder

9.	Endorsement of any imported, exported or re‑exported product in respect of which a halal certificate has been issued

10.	Use of a specified halal certification mark —

(a)	for any poultry processed at an abattoir

$0.10 per poultry on which mark is applied

(b)	for any product

$40 per type, description or brand of product

(c)	for any product at a product processing facility

$30 per type, description or brand of product

(d)	for any endorsed imported, exported or re‑exported product in respect of which a halal certificate has been issued

$0.70 per carton or drum

Saving provision

3. Despite rule 2, the Schedule to the Administration of Muslim Law (Halal Certificates) Rules as in force immediately before 1 February 2018 continues to apply, on and after that date, to —

(a)

an application made before that date under section 88A(2) of the Act for a halal certificate in relation to any product, service or activity;

(b)

any halal certificate issued pursuant to an application mentioned in paragraph (a);

(c)

any use of a specified halal certification mark, if the approval under section 88A of the Act to use that mark was granted pursuant to an application made before that date for such approval; and

(d)

an endorsement of any imported, exported or re‑exported product in respect of which a halal certificate has been issued, if —

(i)	the halal certificate is issued pursuant to an application mentioned in paragraph (a); and
(ii)	the application for the endorsement is made before that date.
