Control of Plants (Import of Fresh Fruits and
Vegetables) (Amendment) Rules 1997

In exercise of the powers conferred by section 46 of the Control of Plants Act, the Minister for National Development hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Control of Plants (Import of Fresh Fruits and Vegetables) (Amendment) Rules 1997 and shall come into operation on 1st April 1997.

Amendment of rule 2

2. Rule 2 of the Control of Plants (Import of Fresh Fruits and Vegetables) Rules (R 1) (referred to in these Rules as the principal Rules) is amended by deleting the definition of “permit”.

Amendment of rule 3

3. Rule 3 of the principal Rules is amended by deleting the words “or permit” in paragraphs (1) and (2) and in the marginal note.

Amendment of rule 4

4. Rule 4 of the principal Rules is amended by deleting the words “or permit” in paragraphs (1) to (5) and in the marginal note.

Amendment of rule 5

5. Rule 5 of the principal Rules is amended —

(a)	by deleting the words “or permit” in the marginal note; and
(b)	by deleting paragraph (2).

Amendment of rule 7

6. Rule 7 of the principal Rules is amended —

(a)	by deleting the words “duplicate licence” in paragraphs (1), (4) and (5) and substituting in each case the words “certified true copy of a licence”;
(b)	by deleting the words “duplicate licence” in the third line of paragraph (2) and substituting the words “certified true copy of a licence”;
(c)	by deleting the words “duplicate licence” in the fourth line of paragraph (2) and substituting the words “certified true copy of the licence”;
(d)	by deleting the words “duplicate licence” in the first line of paragraph (3) and substituting the words “certified true copy of a licence”; and
(e)	by deleting the words “duplicate licence” in the third and fourth lines of paragraph (3) and substituting the words “certified true copy of the licence”.

Deletion and substitution of rule 8

7. Rule 8 of the principal Rules is deleted and the following rule substituted therefor:

“Licence not transferable

8. No licensee shall transfer or assign the benefit of his licence to any other person.”.

Amendment of rule 9

8. Rule 9 of the principal Rules is amended by deleting the words “or permit” in the second and in the third lines and in the marginal note.

Amendment of rule 10

9. Rule 10 of the principal Rules is amended —

(a)	by deleting the words “or permit” wherever they appear in paragraphs (1) to (4) and in the marginal note;
(b)	by deleting the words “or holder of the permit” in the second line of paragraph (1); and
(c)	by deleting the words “or holder of the permit, as the case may be,” in paragraphs (2) and (3).

Amendment of rule 11

10. Rule 11 of the principal Rules is amended —

(a)	by deleting the words “or is not accompanied by a valid permit where one is required in respect of the consignment” in paragraphs (1) and (2); and
(b)	by deleting the words “or accompanied by permit” in the marginal note.

Amendment of rule 16

11. Rule 16 of the principal Rules is amended by deleting the words “or permit” in the fourth line.

Amendment of Schedule

12. The Schedule to the principal Rules is amended by deleting items 2 and 3 and substituting the following items:

“2.	For the approval of inward, outward or transhipment declarations

$2.50 per declaration

3.	For a certified true copy of a document

$6 per copy.”.
