Control of Plants Act
(Chapter 57A)
CONTROL OF PLANTS (CULTIVATION OF PLANTS) (LICENSING AND CERTIFICATION) (AMENDMENT) RULES 1997
In exercise of the powers conferred by section 46 of the Control of Plants Act, the Minister for National Development hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Control of Plants (Cultivation of Plants) (Licensing and Certification) (Amendment) Rules 1997 and shall come into operation on 1st April 1997.
Amendment of rule 2
2.  Rule 2 of the Control of Plants (Cultivation of Plants) (Licensing and Certification) Rules (R 2) (referred to in these Rules as the principal Rules) is amended —
(a)by deleting the words “or a provisional pesticide operator’s certificate” in the third line of the definition of “pesticide operator”; and
(b)by deleting the definition of “provisional pesticide operator’s certificate”.
Amendment of heading of Part II
3.  The heading of Part II of the principal Rules is amended by inserting, immediately before the word “LICENCE”, the word “FARM”.
Deletion and substitution of rule 9
4.  Rule 9 of the principal Rules is deleted and the following rule substituted therefor:
Replacement of lost or defaced licence
9.—(1)  Where a licence has been lost or defaced before its expiry, the licensee may apply to the Director for the issue of a certified true copy of the licence.
(2)  Upon receiving an application under paragraph (1) and the payment of the appropriate fee specified in the First Schedule, the Director shall issue a certified true copy of the licence to the licensee and the certified true copy of the licence so issued shall have the same effect as the original thereof.
(3)  Any licensee to whom a certified true copy of a licence has been issued in replacement of a licence which he has lost shall, upon discovering the original licence, forthwith return the certified true copy of the licence to the Director.
(4)  No certified true copy of a licence shall be issued in place of a defaced licence unless the defaced licence is surrendered to the Director for cancellation.
(5)  No refund shall be made for the fee paid —
(a)for a certified true copy of a licence upon its return to the Director under paragraph (3); or
(b)for a licence surrendered to the Director under paragraph (4).”.
Amendment of rule 15
5.  Rule 15 of the principal Rules is amended by deleting paragraphs (2) to (5) and substituting the following paragraphs:
(2)  Every pesticide operator’s certificate shall be in such form as the Director may determine.
(3)  Notwithstanding paragraph (1), the Director may refuse to issue a pesticide operator’s certificate without assigning any reason.
(4)  The Director may at any time add to, vary or revoke, any of the conditions subject to which a pesticide operator’s certificate has been issued.”.
Amendment of rule 16
6.  Paragraph (2) of rule 16 of the principal Rules is deleted.
Deletion and substitution of rule 17
7.  Rule 17 of the principal Rules is deleted and the following rule substituted therefor:
Renewal, replacement, transfer and alteration of pesticide operator’s certificate
17.  Rules 7, 9, 10, and 11 shall apply, with the necessary modifications, to a pesticide operator’s certificate as they apply to a licence.”.
Amendment of rule 18
8.  Rule 18 of the principal Rules is amended by deleting the words “or a provisional pesticide operator’s certificate” in the second and third lines.
Amendment of rule 25
9.  Rule 25 of the principal Rules is amended by deleting the words “or provisional pesticide operator’s certificate” in the fourth and fifth lines.
Amendment of First Schedule
10.  The First Schedule to the principal Rules is amended —
(a)by deleting the words “and (2)” in the marginal reference;
(b)by inserting, immediately before the word “licence” in item 1, the word “farm”; and
(c)by deleting items 3 and 4 and substituting the following item:
“3.For a certified true copy of a document
$6 per copy.”.
