Fire Safety Act
(Chapter 109A)
Fire Safety (Residential Buildings Requiring Fire Certificate) Order 2010
In exercise of the powers conferred by section 20(1B) of the Fire Safety Act, the Minister for Home Affairs hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Fire Safety (Residential Buildings Requiring Fire Certificate) Order 2010 and shall come into operation on 29th March 2010.
Buildings requiring fire certificate
2.—(1)  Every residential building that —
(a)exceeds 24 metres in habitable height; and
(b)is, or is required, to be installed with any of the following:
(i)a wet riser system;
(ii)an automatic fire alarm system; or
(iii)a sprinkler system,
is designated to be a building whose owners or occupiers are required under section 20 of the Act to apply and obtain a fire certificate from the Commissioner.
(2)  In this paragraph —
“habitable height”, in relation to a building, means the height measured from the lowest level a fire engine can have access to the building, to the finished floor of the highest habitable floor in that building;
“residential building” means a building or part of a building that is lawfully used or intended to be used for residential (landed or non-landed) purposes but not public housing.
