Chapter 234
Poisons (Amendment No. 2) Rules 1999
In exercise of the powers conferred by section 20(1) of the Poisons Act, the Minister for Health hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Poisons (Amendment No. 2) Rules 1999 and shall come into operation on 1st April 1999.
Amendment of rule 3
2.  Rule 3 of the Poisons Rules (R 1) is amended by deleting paragraph (1) and substituting the following paragraph:
A licence to import, store and sell by wholesale poisons included in the Poisons List shall be in Form A of the Eighth Schedule.”.
Amendment of rule 5
3.  Rule 5 of the Poisons Rules is amended by deleting paragraph (1).
Deletion of rules 6, 7, 14A, 14B, 14C and 17
4.  Rules 6, 7, 14A, 14B, 14C and 17 of the Poisons Rules are deleted.
Amendment of rule 23
5.  Rule 23(1) of the Poisons Rules is amended —
(a)by deleting sub-paragraph (c); and
(b)by deleting the words “sodium hydroxide, potassium hydroxide or” in the 1st line of sub-paragraph (d).
Amendment of rule 35
6.  Rule 35 of the Poisons Rules is amended by deleting “5(1), 6, 17(1),” in paragraph (a).
Amendment of First Schedule
7.  The First Schedule to the Poisons Rules is amended —
(a)by deleting the following items:

Amendment of Second Schedule
8.  The Second Schedule to the Poisons Rules is amended —
(a)by deleting the paragraph under the sub-heading “General Exemptions” of Group I and substituting the following paragraph:
Adhesives; anti-fouling compositions; builders’ materials; ceramics; distempers; electrical valves; enamels; explosives; fillers; fireworks; fluorescent lamps; glazes; glue; inks; lacquer solvents; loading materials; matches; motor fuels and lubricants; paints other than pharmaceutical paints; photographic paper; pigments; plastics; propellants; rubber; varnishes; vascular plants and their seeds.”;
(b)by deleting the following items and their entries relating thereto under the sub-heading “Special Exemptions” of Group II:

Amendment of Fourth Schedule
9.  The Fourth Schedule to the Poisons Rules is amended by deleting the following items and their entries relating thereto:
Hydrocyanic acid; cyanides, other than ferrocyanides and ferricyanides
Potassium hydroxide
Sodium hydroxide.”.
Amendment of Fifth Schedule
10.  The Fifth Schedule to the Poisons Rules is amended —
(a)by deleting the following items in paragraph 11:
Dinitrocresols (DNOC); their compounds with a metal or a base except preparations for the treatment of human ailments
Dinosam, its compounds with a metal or a base
Dinoseb, its compounds with a metal or a base
Drazoxolon; its salts

Amendment of Eighth Schedule
13.  The Eighth Schedule to the Poisons Rules is amended —
(a)by deleting the words “PART I OF” in the heading of FORM A; and
(b)by deleting FORM B.
Amendment of Ninth Schedule
14.  The Ninth Schedule to the Poisons Rules is amended —
(a)by deleting the words “Part I of” in paragraphs 1 and 3;
(b)by deleting paragraph 2; and
(c)by deleting paragraph 4 and substituting the following paragraph:
4.  The fees for making amendments to a licence or a set of licences on any one occasion shall be $30 in respect of poisons included in the Poisons List from 1st April 1996 to 30th September 1997, and $35 on or after 1st October 1997.”.
Amendment of Tenth Schedule
15.  The Tenth Schedule to the Poisons Rules is amended by deleting Rule 23(1)(c) and the entries relating thereto.
Deletion of Eleventh, Twelfth and Thirteenth Schedules
16.  The Eleventh, Twelfth and Thirteenth Schedules to the Poisons Rules are deleted.
Miscellaneous amendments
17.  The Poisons Rules are amended by deleting the words “Part I of” wherever they appear in the following rules:
Rules 10, 12(b) and 16.
