Order 2021

In exercise of the powers conferred by section 4 of the Government Procurement Act, the Minister for Finance makes the following Order:

Citation and commencement

1.—(1) This Order is the Government Procurement (Application) (Amendment) Order 2021 and, except for paragraphs 4 and 5, is deemed to have come into operation on 11 February 2021.

(2) Paragraph 5 is deemed to have come into operation on 21 November 2019.

(3) Paragraph 4 is deemed to have come into operation on 1 January 2021.

Amendment of paragraph 4

2. Paragraph 4 of the Government Procurement (Application) Order (O 1) (called in this Order the principal Order) is amended —

(a)

by inserting, immediately after the words “the European Union,” in sub‑paragraph (1), the words “the United Kingdom,”; and

(b)

by inserting, immediately after sub‑paragraph (2P), the following sub‑paragraphs:

“(2Q) Any of the following procurements is a procurement subject to the Act in relation to the United Kingdom if the value of the contract in relation to the procurement is equal to or exceeds 50,000 Special Drawing Rights:

(a)

a procurement by a contracting authority set out in Part I of the Second Schedule of —

(i)	goods;
(ii)	one or more of the services set out in the Eleventh Schedule; or
(iii)	a combination of goods and one or more of such services;

(b)

a procurement by a contracting authority set out in Part III of the Second Schedule of any of the goods set out in the Fifth Schedule or a combination of those goods.

(2R) A procurement by a contracting authority set out in Part II or IIC of the Second Schedule is a procurement subject to the Act in relation to the United Kingdom if the value of the contract in relation to the procurement is equal to or exceeds 400,000 Special Drawing Rights and if the procurement is of —

(a)	goods;
(b)	one or more of the services set out in the Eleventh Schedule; or
(c)	a combination of goods and one or more of such services.

(2S) Subject to the exceptions set out in Part IIC of the Second Schedule, a procurement by a contracting authority set out in Part I, II or IIC of the Second Schedule of any service set out in the Fourth Schedule is a procurement subject to the Act in relation to the United Kingdom if the value of the contract in relation to the procurement is equal to or exceeds 5 million Special Drawing Rights.”.

Amendment of paragraph 8

3. Paragraph 8(1) of the principal Order is amended by inserting, immediately after the words “the European Union,”, the words “the United Kingdom,”.

Amendment of First Schedule

4. The First Schedule to the principal Order is amended —

(a)

by deleting item 4 of Part I; and

(b)

by inserting, immediately after item 18 of Part II, the following items:

“19.	Switzerland

20.	United Kingdom”.

Amendment of Second Schedule

5. Part IIC of the Second Schedule to the principal Order is amended by inserting, immediately after item 28, the following item:

“28A.

Singapore Sports Council”.

Amendment of Fifth Schedule

6. The Fifth Schedule to the principal Order is amended by deleting the words “AND (2N)(b)” in the Schedule heading and substituting the words “, (2N)(b) AND (2Q)(b)”.

Amendment of Eleventh Schedule

7. The Eleventh Schedule to the principal Order is amended by deleting the words “AND (2O)(b)” in the Schedule heading and substituting the words “, (2O)(b), (2Q)(a)(ii) AND (2R)(b)”.
