Building Control Act
(Chapter 29)
Building Control (Amendment) Regulations 1997
In exercise of the powers conferred by section 50 of the Building Control Act, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Building Control (Amendment) Regulations 1997 and shall come into operation on 25th April 1997.
Amendment of regulation 2
2.  Regulation 2 of the Building Control Regulations (Rg 5) (referred to in these Regulations as the principal Regulations) is amended by deleting the definition of “plan” in paragraph (1) and substituting the following definition:
“ “plan”, in relation to any building works —
(a)includes drawings, details, diagrams, calculations, structural details and structural calculations showing or relating to the building works; and
(b)if prepared in electronic form, includes the medium in which the plans of building works have been stored;”.
Amendment of regulation 4
3.  Regulation 4 of the principal Regulations is amended —
(a)by inserting, immediately after the word “Regulations” in the second line of paragraph (a), the words “on such paper or in such electronic form as the Building Authority may determine”;
(b)by deleting sub-paragraphs (iv) and (v) of paragraph (a); and
(c)by re-numbering the regulation as paragraph (1) of that regulation and by inserting immediately thereafter the following paragraph:
(2)  One set of plans of building works shall be submitted.”.
Amendment of regulation 6
4.  Regulation 6 of the principal Regulations is amended —
(a)by deleting sub-paragraph (b) of paragraph (1) and substituting the following sub-paragraph:
(b)be submitted —
(i)on standard metric size sheets of the international A series; or
(ii)on such electronic form as the Building Authority may determine;”;
(b)by inserting, immediately after paragraph (1), the following paragraph:
(1A)  Where the plans are prepared in electronic form, the qualified person shall authenticate the plans in electronic form in such manner as the Building Authority may require.”; and
(c)by deleting paragraph (3) and substituting the following paragraph:
(3)  All plans of building works submitted under the Act shall, whether submitted on paper or in electronic form, be visible or capable of being displayed in a clear and intelligible manner on a suitably light background.”.
Amendment of regulation 7
5.  Regulation 7 of the principal regulations is amended by deleting paragraphs (a) and (b) and substituting the following paragraphs:
“(a)
site plan
1:500; and
(b)
all other plans
1:200.”.
Deletion and substitution of regulation 13
6.  Regulation 13 of the principal Regulations is deleted and the following regulation substituted therefor:
Non-acceptance or disapproval of plans
13.  The Building Authority may refuse to accept or disapprove an application for approval of plans of building works if —
(a)the application or the plans of building works submitted are not in accordance with any provision of the Act or these Regulations;
(b)the application is not received in the appropriate form or it does not contain the particulars required by the appropriate form; or
(c)such fees as are prescribed by these Regulations have not been paid.”.
Amendment of regulation 14
7.  Regulation 14 of the principal Regulations is amended by deleting the words “and disapproval” in the marginal note.
Deletion and substitution of regulation 15
8.  Regulation 15 of the principal Regulations is deleted and the following regulation substituted therefor:
Disapproval of plans
15.—(1)  Where any plan of building works has been disapproved, the Building Authority may return the disapproved plan to the qualified person.
(2)  Where any plan has been withdrawn by the qualified person or applicant before or after approval, the Building Authority may return the plan to the qualified person or applicant, as the case may be.
(3)  Where any plan, whether on paper or in electronic form, that is to be returned by the Building Authority is not collected within one month from the office of the Authority, the Authority may destroy or dispose of the plan (including the medium in which it is stored) in any way it thinks fit.”.
Amendment of regulation 17
9.  Regulation 17 of the principal regulations is amended by inserting, immediately after the word “Authority” at the end thereof, the words “or such other period as may be extended by the Building Authority”.
