Housing and Development Act

Housing and Development (Polling for Upgrading Works) (Amendment) Rules 2009
In exercise of the powers conferred by section 65K of the Housing and Development Act, the Minister for National Development hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Housing and Development (Polling for Upgrading Works) (Amendment) Rules 2009 and shall come into operation on 1st June 2009.
Amendment of rule 2
2.  Rule 2(1) of the Housing and Development (Polling for Upgrading Works) Rules (R 7) (referred to in these Rules as the principal Rules) is amended by inserting, immediately after the definition of “flat upgrading works register”, the following definitions:
“ “HDB flat” means a house or flat sold under the provisions of the Act;
“Lease Buyback Scheme” means a scheme administered by the Board under which a lessee of an HDB flat who has been approved by the Board to take part in the scheme enters into an agreement with the Board to reduce the term of the lease of his HDB flat, in consideration of a sum of money part of which is to be used for the purchase of an annuity from the Central Provident Fund Board;”.
Amendment of rule 3
3.  Rule 3(1B) of the principal Rules is amended by inserting, immediately after the words “all persons who”, the words “are entitled to have their names entered in the register as owners of such flats and”.
Amendment of rule 4
4.  Rule 4 of the principal Rules is amended —
(a)by deleting the word “and” at the end of paragraph (1A)(b);
(b)by deleting the full-stop at the end of sub-paragraph (c) of paragraph (1A) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(d)any sole purchaser or joint purchasers of a residential flat which is the subject of an agreement entered into under the Lease Buyback Scheme.”; and
(c)by inserting, immediately after the words “is rented out by the Board” in paragraph (4), the words “or is the subject of an agreement entered into under the Lease Buyback Scheme”.
