(Transparency and Effective Control)
(Amendment) Regulations 2023

In exercise of the powers conferred by section 84A of the Trustees Act 1967, the Minister for Law makes the following Regulations:

Citation and commencement

1.—(1) These Regulations are the Trustees (Transparency and Effective Control) (Amendment) Regulations 2023 and, except for regulation 4(d), are deemed to have come into operation on 31 December 2021.

(2) Regulation 4(d) comes into operation on 28 April 2023.

Amendment of regulation 2

2. In the Trustees (Transparency and Effective Control) Regulations 2017 (G.N. No. S 151/2017) (called in these Regulations the principal Regulations), in regulation 2, in the definition of “identity card”, replace “(Cap. 201)” with “1965”.

Amendment of regulation 5

3. In the principal Regulations, in regulation 5(4) —

(a)	in sub-paragraph (c), replace “Part XIA of the Companies Act (Cap. 50)” with “Part 11A of the Companies Act 1967”;
(b)	in sub-paragraphs (d) and (e), after “Companies Act”, insert “1967”;
(c)	in sub-paragraph (f), replace “Part VIA of the Limited Liability Partnerships Act (Cap. 163A)” with “Part 6A of the Limited Liability Partnerships Act 2005”; and
(d)	in sub-paragraph (g), after “Limited Liability Partnerships Act”, insert “2005”.

Amendment of regulation 8

4. In the principal Regulations, in regulation 8(5) —

(a)	in the definitions of “advocate and solicitor” and “practising certificate”, replace “(Cap. 161)” with “1966”;
(b)	in the definition of “law practice”, after “Legal Profession Act”, insert “1966”;
(c)	in the definition of “specified person”, in paragraph (a), replace “(Cap. 186)” with “1970”;
(d)	in the definition of “specified person”, in paragraph (a), replace “section 27A(6) of the Monetary Authority of Singapore Act 1970, read with section 27A(7) of that Act” with “section 2 of the Financial Services and Markets Act 2022”;
(e)	in the definition of “specified person”, in paragraph (b), replace “(Cap. 33A)” with “2006”;
(f)	in the definition of “specified person”, in paragraph (c), replace “(Cap. 95A)” with “2010”;
(g)	in the definition of “specified person”, in paragraph (d), delete “(Act 7 of 2019)”;
(h)	in the definition of “specified person”, in paragraph (da), delete “(Act 2 of 2015)”;
(i)	in the definition of “specified person”, in paragraphs (f) and (g), after “Legal Profession Act”, insert “1966”;
(j)	in the definition of “specified person”, in paragraph (h), replace “(Cap. 208)” with “1959”; and
(k)	in the definition of “specified person”, in paragraph (i), replace “(Cap. 2)” with “2004”.

Amendment of regulation 11

5. In the principal Regulations, in regulation 11, replace “Part VII” with “Part 7”.

Amendment of First Schedule

6. In the principal Regulations, in the First Schedule —

(a)	in paragraph 1, replace “(Cap. 260)” with “1915”;
(b)	in paragraph 2(a), replace “(Cap. 336)” with “2005”;
(c)	in paragraph 2(b), after “Trust Companies Act”, insert “2005”;
(d)	in paragraph 2(c), replace “(Cap. 19)” with “1970”;
(e)	in paragraph 2(d), after “Banking Act”, insert “1970”;
(f)	in paragraph 2(e), replace “(Cap. 289)” with “2001”;
(g)	in paragraph 2(e), replace “(Cap. 289, Rg 10)” with “(Rg 10)”;
(h)	in paragraph 3, after “Securities and Futures Act”, insert “2001”; and
(i)	in paragraph 4, replace “(Cap. 36)” with “1953”.

Amendment of Second Schedule

7. In the principal Regulations, in the Second Schedule —

(a)	in paragraph 3(a), replace “(Cap. 50)” with “1967”;
(b)	in paragraph 3(f), after “Companies Act”, insert “1967”;
(c)	in paragraph 5, in the definitions of “company” and “foreign company”, after “Companies Act”, insert “1967”; and
(d)	in paragraph 5, in the definition of “limited liability partnership”, replace “(Cap. 163A)” with “2005”.
