(Chapter 13)
Arms and Explosives (Exemption from Section 13) Order 2009
In exercise of the powers conferred by section 44B of the Arms and Explosives Act, the Minister for Home Affairs hereby makes the following Order:
Citation and commencement
1.—(1)  This Order may be cited as the Arms and Explosives (Exemption from section 13) Order 2009.
(2)  This Order shall come into operation on 1st June 2009 and shall remain in operation until 30th September 2010 (both dates inclusive).
Definitions
2.  In this Order, unless the context otherwise requires —
“AYG” means the Asian Youth Games 2009;
“relevant authority” means the Officer-in-Charge, Arms and Explosives Branch of the Singapore Police Force;
“YOG” means the Youth Olympics Games 2010.
Exemption for sportsmen and coaches
3.—(1)  Subject to sub-paragraph (2), every sportsman participating in the AYG or YOG and his coach shall be exempt from section 13 of the Act for possessing, controlling or using any air-gun, air pellet or fencing sword —
(a)for the purpose of any competition involving arms at the AYG or YOG; or
(b)for any related purpose connected to any such competition.
(2)  In the case of an air-gun, sub-paragraph (1) applies if, and only if, the sportsman or coach, as the case may be, possesses, controls or uses the air-gun at a shooting range that is approved by the relevant authority (referred to in this Order as an approved shooting range).
Exemption for AYG and YOG organising committees
4.  The respective organising committees of the AYG and the YOG and every member thereof shall be exempt from section 13 of the Act for arranging or authorising the import, export, storage or transport of any air-gun, air pellet or fencing sword —
(a)for the purpose of any competition involving arms at the AYG or YOG, as the case may be; or
(b)for any related purpose connected to any such competition.
Exemption for import and export by approved freight forwarders
5.  A freight forwarder shall be exempt from section 13 of the Act for importing or exporting any air-gun, air pellet or fencing sword if —
(a)the air-gun, air pellet or fencing sword is for the purpose of any competition involving arms at the AYG or YOG or for any related purpose connected to any such competition;
(b)the freight forwarder is approved to do so by or on behalf of the organising committee of the AYG or YOG; and
(c)in the case of any air-gun, air pellet or fencing sword imported for the purpose specified in sub-paragraph (a), it is exported without delay after the end of the AYG or YOG, as the case may be.
Exemption for storage
6.  A person shall be exempt from section 13 of the Act for storing any air-gun, air pellet or fencing sword if —
(a)the air-gun, air pellet or fencing sword is for the purpose of any competition involving arms at the AYG or YOG or for any related purpose connected to any such competition;
(b)the person is approved to do so by or on behalf of the organising committee of the AYG or YOG;
(c)the air-gun, air pellet or fencing sword is stored securely at such premises as the relevant authority approves (referred to in this Order as approved storage premises); and
(d)the person records in a register every movement of each air-gun, air pellet or fencing sword into or out of the approved storage premises and makes the register available to inspection at any reasonable time by the relevant authority.
Exemption for transporters
7.  A person shall be exempt from section 13 of the Act for transporting any air-gun directly (and without detour) from any approved storage premises to an approved shooting range and vice versa if —
(a)the air-gun is for the purpose of any competition involving arms at the AYG or YOG or for any related purpose connected to any such competition;
(b)the person is approved to do so by or on behalf of the organising committee of the AYG or YOG; and
(c)the air-gun is escorted at all time during transport by one or more auxiliary police officers of an Auxiliary Police Force within the meaning of the Police Force Act (Cap. 235).
