COVID-19 (Temporary Measures)
(Cessation of Section 28 for
Certain Proceedings) Order 2022
In exercise of the powers conferred by section 28(13) of the COVID-19 (Temporary Measures) Act 2020, the Minister for Law, in consultation with the Chief Justice, makes the following Order:
Citation and commencement
1.  This Order is the COVID-19 (Temporary Measures) (Cessation of Section 28 for Certain Proceedings) Order 2022 and comes into operation on 1 April 2022.
Cessation of section 28 of Act
2.  The Minister declares that section 28 of the Act ceases to apply in relation to the following proceedings, whether commenced before, on or after 1 April 2022 and in respect of which no order under section 28(1) of the Act has been made before 1 April 2022:
(a)any proceedings in a Family Court constituted under section 3 of the Family Justice Act 2014;
(b)any proceedings in a Youth Court constituted under section 3 of the Family Justice Act 2014;
(c)any proceedings in a State Court constituted under section 3 of the State Courts Act 1970;
(d)any proceedings in the Supreme Court constituted under Article 94 of the Constitution of the Republic of Singapore, except any proceedings before a court of 3 Supreme Court Judges under the Legal Profession Act 1966.
Saving provision
3.  Despite paragraph 2, section 28 of the Act continues to apply to or in relation to —
(a)any court proceedings in respect of which an order under section 28(1) of the Act was made before 1 April 2022;
(b)any evidence given by an accused person or a witness in any court proceedings, by means of a live video or live television link that is created using a remote communication technology approved by the Chief Justice, pursuant to an order under section 28(1) of the Act made before 1 April 2022; and
(c)any appearance made (other than to give evidence) by an accused person or a witness in any court proceedings, by means of a live video, live television link or live audio link that is created using a remote communication technology approved by the Chief Justice, pursuant to an order under section 28(1) of the Act made before 1 April 2022.
