Government Procurement
(Application) (Amendment)
Order 2012

In exercise of the powers conferred by section 4 of the Government Procurement Act, the Minister for Finance hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Government Procurement (Application) (Amendment) Order 2012 and shall come into operation on 1st June 2012.

Amendment of paragraph 4

2. Paragraph 4 of the Government Procurement (Application) Order (O 1) is amended —

(a)

by deleting the words “or II” in sub-paragraph (2)(a);

(b)

by deleting the formula in sub-paragraph (2) and substituting the following formula:

“

”;

(c)

by deleting the words “A is the applicable amount; and” in sub-paragraph (2);

(d)

by inserting, immediately after sub-paragraph (2), the following sub-paragraphs:

“(2A) A procurement by a contracting authority set out in Part II of the Second Schedule of —

(a)	goods;
(b)	one or more applicable services; or
(c)	a combination of goods and one or more applicable services,

is a procurement subject to the Act in relation to the United States of America if the value of the contract in relation to the procurement is equal to or exceeds $820,560.

(2B) A procurement by a contracting authority set out in Part I or II of the Second Schedule of any service set out in the Fourth Schedule, is a procurement subject to the Act in relation to the United States of America if the value of the contract in relation to the procurement is equal to or exceeds $10,257,000.”;

(e)

by deleting the words “sub-paragraph (2)” in sub-paragraph (3) and substituting the words “sub-paragraphs (2) and (2A)”;

(f)

by deleting the definition of “applicable amount” in sub-paragraph (3);

(g)

by deleting the word “or” at the end of paragraph (a) of the definition of “applicable service” in sub-paragraph (3); and

(h)

by deleting paragraph (b) of the definition of “applicable service” in sub-paragraph (3).

Amendment of First Schedule

3. The First Schedule to the Government Procurement (Application) Order is amended by deleting the full-stop at the end of item 13, and by inserting immediately thereafter the following item:

“14. Armenia.”.
