Medicines (Cosmetic Products) (Specification and Prohibition) Order 1996

In exercise of the powers conferred by sections 9, 30 and 54 of the Medicines Act, the Minister for Health hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Medicines (Cosmetic Products) (Specification and Prohibition) Order 1996 and shall come into operation on 1st June 1997.

Definitions

2. In this Order —

“Category I product” means any cosmetic product falling within Part I of the First Schedule;

“Category II product” means any cosmetic product falling within Part II of the First Schedule;

“cosmetic product” means any product intended to be rubbed, poured, sprinkled or sprayed on, or introduced into, or otherwise applied to, the human body or part thereof for cleansing, beautifying, promoting attractiveness or altering the appearance, and includes a deodorant or any depilatory substance but does not include a soap.

Types of cosmetic products to which Order does not apply

3. This Order shall not apply to —

(a)	any cosmetic product which is also a medicinal product, and the Act and any subsidiary legislation made thereunder relating to medicinal products shall apply to such a product;
(b)	any cosmetic product which is imported into Singapore solely for direct re-exportation out of Singapore, subject to such terms and conditions as may be imposed by the licensing authority; and
(c)	any cosmetic product as may be approved by the Director of Medical Services.

Cosmetic products subject to provisions of Act

4.—(1) For the purposes of section 54 of the Act, cosmetic products are substances appearing to the Minister to be substances which are not medicinal products but which are manufactured, sold, supplied, imported or exported for use wholly or partly as a cosmetic, and subject to the exceptions and modifications specified in the second column of Part I of the Second Schedule, the provisions of the Act set out in the first column of that Part shall have effect in relation to such description or class of cosmetic products specified in the third column of that Part as those provisions have effect in relation to medicinal products.

(2) Sections 5 (2) and 6(1), (2) and (4) of the Act shall not apply to Category II products if the conditions specified in Part II of the Second Schedule are satisfied.

Prohibition on sale, etc., of certain cosmetic products

5. The sale, supply or importation of any cosmetic product which fails to comply with any of the requirements set out in paragraph 6 is, under section 30 of the Act, prohibited as it appears to the Minister to be necessary to do so in the interest of safety.

Restrictions on inclusion of certain substances

6.—(1) A cosmetic product shall not contain any substance listed in Part I of the Third Schedule.

(2) A cosmetic product shall not contain any substance listed in the first column of Part II of the Third Schedule unless the matters specified in the second and third columns of that Part in relation to that substance are complied with.

(3) A cosmetic product of the type or class specified in the second column of Part III of the Third Schedule shall not contain any colour additive listed in the first column of that Part.

Existing law not affected

7. Nothing in this Order shall operate to relieve any person of any duty or liability imposed upon him by the provisions of any other written law for the time being in force.
