Education Endowment Scheme (Edusave Scholarships) (Amendment) Regulations 2007

In exercise of the powers conferred by section 24(a) of the Education Endowment Scheme Act, the Minister for Education hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Education Endowment Scheme (Edusave Scholarships) (Amendment) Regulations 2007 and shall be deemed to have come into operation on 1st January 2006.

Amendment of regulation 2

2. Regulation 2 of the Education Endowment Scheme (Edusave Scholarships) Regulations (Rg 2) (referred to in these Regulations as the principal Regulations) is amended by inserting, immediately after the definition of “junior college”, the following definitions:

“ “leave of absence fees”, in relation to a pupil, means the fees payable by him to the school in which he is enrolled, during his period of absence from the school under a leave of absence scheme of the school;

“leave of absence scheme”, in relation to a school, means a scheme offered by the school as required by the Ministry, under which a pupil of the school —

(a)	may continue to be enrolled in the school while he is absent from the school for a period of time in order to accompany his parent or parents who is or are overseas for work or work-related training; and
(b)	may resume attending the school on the expiration of that period of time;”.

Amendment of regulation 4

3. Regulation 4 of the principal Regulations is amended —

(a)	by deleting the words “full 4 years” in paragraph (1)(a) and substituting the words “entire duration”;
(b)	by deleting the words “full 6 years” in paragraph (1)(b) and substituting the words “entire duration”; and
(c)	by deleting the words “annual school fees” wherever they appear in paragraph (2) and substituting in each case the words “school fees or leave of absence fees, or both, as the case may be,”.

Amendment of regulation 9

4. Regulation 9 of the principal Regulations is amended by deleting the words “annual school fees” and substituting the words “school fees or leave of absence fees”.

Amendment of regulation 12

5. Regulation 12(1) of the principal Regulations is amended by deleting the words “annual school fees” wherever they appear and substituting in each case the words “school fees or leave of absence fees, or both, as the case may be,”.

Amendment of regulation 14B

6. Regulation 14B of the principal Regulations is amended —

(a)

by deleting the words “annual school fees” wherever they appear in paragraph (2) and substituting in each case the words “school fees or leave of absence fees, or both, as the case may be,”;

(b)

by deleting the word “The” in paragraph (3) and substituting the words “Subject to paragraph (4), the”; and

(c)

by inserting, immediately after paragraph (3), the following paragraphs:

“(4) If the Edusave (Integrated Programme Schools) Scholar referred to in paragraph (3) is absent from the school for a period in any year under a leave of absence scheme offered by the school, the value of the scholarship shall be equal to the total of —

(a)

the amount of any leave of absence fees which he has to pay to that school for that period, less —

(i)	the total amount of school fees and standard miscellaneous fees which he would have had to pay to the school for that period if he had not been absent under the leave of absence scheme; and
(ii)	the total amount of subsidy granted to him in respect of his leave of absence fees under any special education programme or scholarship administered or offered by the Ministry; and

(b)

the amount of any special additional miscellaneous fees which he has to pay to that school for the rest of that year less the total amount of subsidy granted to him in respect of such fees under any special education programme or scholarship administered or offered by the Ministry.

(5) If the amount computed according to paragraph (4)(a) is a negative amount, that amount shall be regarded as zero.”.

Amendment of regulation 14C

7. Regulation 14C of the principal Regulations is amended —

(a)

by inserting, immediately after the words “school fees” in the 4th line of paragraph (2), the words “or leave of absence fees, or both, as the case may be,”;

(b)

by deleting the words “annual school fees” in paragraph (2)(b) and substituting the words “school fees or leave of absence fees, or both, as the case may be,”;

(c)

by deleting the word “The” in paragraph (3) and substituting the words “Subject to paragraph (4), the”; and

(d)

by inserting, immediately after paragraph (3), the following paragraphs:

“(4) If the Edusave (Integrated Programme Schools) Scholar referred to in paragraph (3) is absent from the school for a period while he is provisionally enrolled therein, under a leave of absence scheme offered by the school, the value of the provisional scholarship shall be equal to the total of —

(a)

the amount of any leave of absence fees which he has to pay to that school for that period, less —

(i)	the total amount of school fees and standard miscellaneous fees which he would have had to pay to the school for that period if he had not been absent under the leave of absence scheme; and
(ii)	the total amount of subsidy granted to him in respect of his leave of absence fees under any special education programme or scholarship administered or offered by the Ministry; and

(b)

the amount of any special additional miscellaneous fees which he has to pay to that school for the rest of the period during which he is provisionally enrolled, less the total amount of subsidy granted to him in respect of such fees under any special education programme or scholarship administered or offered by the Ministry.

(5) If the amount computed according to paragraph (4)(a) is a negative amount, that amount shall be regarded as zero.”.

Amendment of regulation 14H

8. Regulation 14H of the principal Regulations is amended by deleting the words “annual school fees or special additional miscellaneous fees” and substituting the words “school fees, special additional miscellaneous fees or leave of absence fees”.

Amendment of regulation 14K

9. Regulation 14K of the principal Regulations is amended —

(a)

by deleting the word “The” in paragraph (1) and substituting the words “Subject to paragraph (1A), the”; and

(b)

by inserting, immediately after paragraph (1), the following paragraphs:

“(1A) If the pupil referred to in paragraph (1) is absent from the school under a leave of absence scheme offered by the school for a period in the year in respect of which he is given the award, the value of the award shall be equal to the total of —

(a)

the amount of any leave of absence fees which he has to pay to that school for that period, less —

(i)	the total amount of school fees and standard miscellaneous fees which he would have had to pay to the school for that period if he had not been absent under the leave of absence scheme; and
(ii)	the total amount of subsidy granted to him in respect of his leave of absence fees under any special education programme or scholarship administered or offered by the Ministry; and

(b)

(1B) If the amount computed according to paragraph (1A)(a) is a negative amount, that amount shall be regarded as zero.”.
