(Undetectable HIV Viral Load)
Regulations 2024
In exercise of the powers conferred by section 73 of the Infectious Diseases Act 1976, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the Infectious Diseases (Undetectable HIV Viral Load) Regulations 2024 and come into operation on 9 April 2024.
Prescribed period preceding sexual activity
2.  For the purpose of section 23(1A) and (1B) of the Act, the prescribed period preceding the sexual activity in question for which a person has maintained an undetectable HIV viral load is 6 months.
Prescribed periods, etc., for tests
3.  For the purpose of section 23(1B) of the Act —
(a)in section 23(1B)(a) of the Act, the prescribed period within which the person must have taken the test mentioned in that provision is 9 months before the sexual activity; and
(b)in section 23(1B)(b) of the Act, the earlier test mentioned in that provision must have been taken no later than 6 months before the test mentioned in paragraph (a).
Prescribed amount of HIV viral load
4.  For the purpose of section 23(1C) of the Act —
(a)in section 23(1C)(a) of the Act, the prescribed amount of HIV for a detectable HIV viral load is 200 copies per millilitre of blood; and
(b)in section 23(1C)(b) of the Act, the prescribed amount of HIV for an undetectable HIV viral load is below 200 copies per millilitre of blood.
Person licensed to provide clinical laboratory service to be recognised laboratory
5.  A person who is licensed under the Healthcare Services Act 2020 to provide a clinical laboratory service within the meaning of the First Schedule to that Act is a recognised laboratory mentioned in section 23(1B) of the Act.
