Active Mobility
(National Day Parade 2022 — Exemption)
Order 2022
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (National Day Parade 2022 — Exemption) Order 2022.
(2)  This Order is in force for the period between 11 April 2022 and 27 August 2022 (both dates inclusive).
Definitions
2.  In this Order —
“emergency” means an actual or imminent event that causes, or threatens to cause —
(a)any harm or danger to the life, health or safety of any individual;
(b)any destruction of, or damage to, any property; or
(c)any harm or danger to the health or safety of the public;
“lorry crane” means a lorry incorporating an articulator arm mounted on the lorry which is used for loading, unloading and lifting of materials or goods;
“Singapore Armed Forces” means the Singapore Armed Forces raised and maintained under the Singapore Armed Forces Act 1972;
“Singapore Civil Defence Force” means the Singapore Civil Defence Force raised and maintained under the Civil Defence Act 1986;
“Singapore Police Force” means the Singapore Police Force established and maintained under the Police Force Act 2004;
“specified display purpose” means the Total Defence Display component of the specified event;
“specified event” means the National Day Parade 2022 event organised by, or for or on behalf of, the Government from 11 April 2022 to 27 August 2022 (both dates inclusive);
“specified footpath” means any footpath within the areas bounded by the black‑coloured lines in the maps set out in the Schedule;
“specified motor vehicle” means a motor vehicle other than any of the following:
(a)a motorised personal mobility device;
(b)a power‑assisted bicycle;
(c)a motorised wheelchair;
(d)a mobility scooter;
(e)an automatic detection device that has wheels, a motor and is constructed to drive itself;
(f)a robotic machine designed to move and operate independently of human control when the computer that controls it is programmed;
(g)a motor vehicle that is constructed to drive itself;
(h)a forklift;
(i)a lorry crane.
Exemption for driving specified motor vehicle
3.  Section 16(1)(b) of the Act does not apply to an individual who drives a specified motor vehicle on any of the specified footpaths under the following conditions:
(a)the individual is authorised by the Singapore Armed Forces, the Singapore Civil Defence Force or the Singapore Police Force to drive the specified motor vehicle for any of the following purposes:
(i)to transport any individual or thing in connection with the specified event;
(ii)for the specified display purpose;
(iii)to stand by in case of, or to respond to, an emergency;
(b)the individual who drives the specified motor vehicle —
(i)possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27) authorising the individual to drive the class of the specified motor vehicle; or
(ii)is exempted under section 49 of the Road Traffic Act 1961 from the requirement of possessing a valid driving licence authorising the individual to drive the class of the specified motor vehicle;
(c)the specified motor vehicle is driven only for a purpose mentioned in sub‑paragraph (a);
(d)the individual who drives the specified motor vehicle must give way to other users of the specified footpath;
(e)unless responding to an emergency, the individual who drives the specified motor vehicle drives at a speed not exceeding —
(i)10 km/h, where the specified motor vehicle is being driven to transport any individual or thing in connection with the specified event; or
(ii)30 km/h, where the specified motor vehicle is being driven for the specified display purpose;
(f)there is in force, at any time the specified motor vehicle is used in connection with the specified event or specified display purpose, a policy of insurance in relation to the specified motor vehicle insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (other than the driver or any passenger of the specified motor vehicle); and
(ii)property damage suffered by any person (other than the driver or any passenger of the specified motor vehicle),
caused by or arising out of the use of the specified motor vehicle;
(g)the risk under the policy of insurance mentioned in sub‑paragraph (f) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
Exemption for driving forklift
4.  Section 16(1)(b) of the Act does not apply to an individual who drives a forklift on any of the specified footpaths under the following conditions:
(a)the individual is authorised by the Singapore Armed Forces, the Singapore Civil Defence Force or the Singapore Police Force to drive the forklift to transport any thing in connection with the specified event;
(b)the individual has attended and passed the Singapore Workforce Skills Qualifications (WSQ) — Operate Forklift Course or obtained any equivalent certification approved by the Singapore Armed Forces;
(c)the forklift is driven only to transport any thing in connection with the specified event;
(d)the individual who drives the forklift must drive at a speed not exceeding 10 km/h;
(e)there is in force, at any time the forklift is used in connection with the specified event, a policy of insurance in relation to the forklift insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (other than the driver or any passenger of the forklift); and
(ii)property damage suffered by any person (other than the driver or any passenger of the forklift),
caused by or arising out of the use of the forklift;
(f)the risk under the policy of insurance mentioned in sub‑paragraph (e) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
Exemption for driving lorry crane
5.  Section 16(1)(b) of the Act does not apply to an individual who drives a lorry crane on any of the specified footpaths under the following conditions:
(a)the individual is authorised by the Singapore Armed Forces, the Singapore Civil Defence Force or the Singapore Police Force to use the lorry crane to transport any individual or thing in connection with the specified event;
(b)the individual who drives the lorry crane —
(i)possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules authorising the individual to drive the lorry crane; or
(ii)is exempted under section 49 of the Road Traffic Act 1961 from the requirement of possessing a valid driving licence authorising the individual to drive the lorry crane;
(c)the individual has attended and passed the Singapore Workforce Skills Qualifications (WSQ) — Operate Lorry Crane Course or obtained any equivalent certification approved by the Singapore Armed Forces;
(d)the lorry crane is driven only to transport any individual or thing in connection with the specified event;
(e)the individual who drives the lorry crane must drive at a speed not exceeding 10 km/h;
(f)there is in force, at any time the lorry crane is used in connection with the specified event, a policy of insurance in relation to the lorry crane insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (other than the driver or any passenger of the lorry crane); and
(ii)property damage suffered by any person (other than the driver or any passenger of the lorry crane),
caused by or arising out of the use of the lorry crane;
(g)the risk under the policy of insurance mentioned in sub‑paragraph (f) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
