Miscellaneous Offences (Public Order and Nuisance) (Festival Auction Assembly) Rules 2000 |

Citation and commencement |
1. These Rules may be cited as the Miscellaneous Offences (Public Order and Nuisance) (Festival Auction Assembly) Rules 2000 and shall come into operation on 30th June 2000. |
Application |
2. These Rules shall apply to any assembly of 5 or more persons in any public road, public place or place of public resort which is organised for the purpose of an auction held in conjunction with any celebration of the Seventh Month Festival of the Chinese Lunar calendar (referred to in these Rules as a festival auction assembly). |
Consent of owner or occupier |
3. No person shall organise, or assist in the organising of, any festival auction assembly unless the previous consent of the owner or occupier of the land on which the festival auction assembly is to be held has been obtained. |
Presence of organiser |
4. A person who organises a festival auction assembly shall be present, or shall arrange for his agent to be present, at all times during the festival auction assembly at the place where the assembly is held. |

5. A person who organises or assists in the organising of any festival auction assembly shall ensure that —

Penalty |
6. Any person who contravenes or fails to comply with rule 3, 4 or 5 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding one month or to both. |
Powers of dispersal |
7. Any police officer may order the dispersal of any festival auction assembly if the assembly is not organised in accordance with these Rules or if a breach of the peace is likely to occur. |
