Environmental Public Health
(Exemption) Regulations 2011
In exercise of the powers conferred by sections 110 and 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Environmental Public Health (Exemption) Regulations 2011 and shall come into operation on 1st July 2011.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“HDB” means the Housing and Development Board established under the Housing and Development Act (Cap. 129);
“refuse, waste or other article” means refuse, waste or other article collected from a residential or commercial property in the housing estates of the HDB within the Town managed by a Town Council;
“specified conservancy and service contractor” means a contractor engaged by a Town Council to provide services to the Town Council in, or in connection with, the collection of refuse from, or the cleaning of, the common property of residential and commercial property in the housing estates of the HDB within the Town of the Town Council;
“Town” and “Town Council” have the same meanings, respectively, as in the Town Councils Act (Cap. 329A).
Exemption of Town Councils
3.  Section 20(1) of the Act shall not apply to, and in relation to, any of the following activities carried out by a Town Council in the discharge of any of its functions and duties under any written law:
(a)authorising or causing the dumping or disposing of refuse, waste or other article from a vehicle in any refuse bin centre or refuse bin compartment located within the Town managed by the Town Council; or
(b)authorising or causing the use of a vehicle for the purpose of dumping or disposing of refuse, waste or other article in any refuse bin centre or refuse bin compartment located within the Town managed by the Town Council.
Exemption of specified conservancy and service contractor, etc.
4.  Section 20(1) of the Act shall not apply to, and in relation to, any of the following activities carried out by a specified conservancy and service contractor engaged by a Town Council referred to in regulation 3 in the discharge of any of the Town Council’s functions and duties under any written law, or by any employee or authorised agent of such a specified conservancy and service contractor:
(a)the dumping or disposing of refuse, waste or other article from a vehicle in any refuse bin centre or refuse bin compartment located within the Town managed by the Town Council; or
(b)the use of a vehicle for the purpose of dumping or disposing of refuse, waste or other article in any refuse bin centre or refuse bin compartment located within the Town managed by the Town Council.
