Building Control (Amendment No. 2) Regulations 1996

In exercise of the powers conferred by section 50 of the Building Control Act, the Minister for National Development hereby makes the following Regulations:

1. These Regulations may be cited as the Building Control (Amendment No. 2) Regulations 1996 and shall come into operation on 26th July 1996.

2. Regulation 14 of the Building Control Regulations (referred to in these Regulations as the principal Regulations) is amended by inserting, immediately after paragraph (2), the following paragraphs:

“(2A) Where any plans of building works have been deemed to have been disapproved under section 6(3A) of the Act —

(a)

the qualified person may —

(i)	upon having complied with any written direction given by the Building Authority under section 6(2) of the Act; and
(ii)	within 90 days of the date on which the plans are deemed to have been disapproved or such period as the Building Authority may allow,

apply to the Building Authority for the plans to be re-considered for approval; and

(b)	the Building Authority may, if it thinks fit and subject to any terms and conditions, approve the plans.

(2B) Where an application under paragraph (2A) is rejected by the Building Authority, the qualified person who made the application shall be precluded from making any further application under that paragraph in respect of the same building plans.”.

3. Regulation 36(5) of the principal Regulations is deleted.

4. The principal Regulations are amended by inserting, immediately after regulation 111, the following regulation:

“Fee for reconsideration of plan

111A. The fee for an application under regulation 14(2A) for the re-consideration of plans shall be $100 or 25% of the prescribed fee paid upon the application for the approval of such plans, whichever is the higher.”.
