Amusement Rides Safety
(Saving and Transitional Provisions)
Regulations 2011
In exercise of the powers conferred by sections 72 and 76 of the Amusement Rides Safety Act 2011, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Amusement Rides Safety (Saving and Transitional Provisions) Regulations 2011 and shall come into operation on 1st July 2011.
Part II of Act not to apply in cases of approval under Building Control Act
2.  Where any person has, before 1st July 2011 —
(a)obtained the approval of the Commissioner of Building Control in accordance with section 5 of the Building Control Act (Cap. 29) for the plans of any building works relating to any building which forms part of an amusement ride or to which an amusement ride is connected; or
(b)submitted an application for the approval referred to in paragraph (a) and obtained such approval on or after 1st July 2011,
Part II of the Act shall not apply in respect of any installation works for that amusement ride.
Commissioner may give directions in relation to installation works
3.—(1)  Where, in relation to any installation works or part thereof of any amusement ride referred to in regulation 2, the Commissioner is of the opinion that the installation works are dangerous or liable to pose a danger to persons who are employed in connection with the installation works, or who are or will be using or operating, or in the vicinity of, the amusement ride being installed, the Commissioner may direct the person directly engaged in carrying out the installation works or the person responsible for the amusement ride, to —
(a)cease the installation works or part thereof, either immediately or within such time as may be specified by the Commissioner; and
(b)where necessary, take, at the expense of the person to whom the direction is given, such remedial measures as the Commissioner may require,
and such installation works or part thereof, as the case may be, shall not be resumed without the consent in writing of the Commissioner.
(2)  The Commissioner may, upon an application made by the person directly engaged in carrying out the installation works or the person responsible for the amusement ride in such form and manner as the Commissioner may require, grant his consent for the installation works or any part thereof to resume if he is satisfied that any such installation works or part thereof, if allowed to resume, will not pose a danger to any person.
(3)  Any person to whom a direction has been given by the Commissioner under paragraph (1) who —
(a)fails to comply with the direction; or
(b)resumes the installation works without the consent in writing of the Commissioner,
shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both.
Inspection and certification of amusement ride after installation
4.—(1)  Upon the completion of the installation of an amusement ride referred to in regulation 2, the person responsible for the amusement ride shall —
(a)appoint a qualified person to inspect, in accordance with section 46 of the Act, the amusement ride and issue a certificate stating that, in the opinion of the qualified person —
(i)the installation works have been properly carried out in accordance with —
(A)the design and specifications and the installation method and programme specified by the designer or manufacturer of the amusement ride, or any deviation therefrom which has been approved in writing by the designer or manufacturer of the amusement ride; and
(B)any direction given by the Commissioner under regulation 3 in respect of the amusement ride; and
(ii)the amusement ride, as installed —
(A)conforms to the requirements prescribed under regulation 7 of the Amusement Rides Safety Regulations 2011 (G.N. No. S 343/2011) in respect of that amusement ride; and
(B)is in a safe working condition and fit for operation; and
(b)in accordance with section 36 of the Act, apply for and obtain from the Commissioner of Civil Defence a certificate of compliance in respect of the fire and rescue management system of the amusement ride.
(2)  An inspection by a qualified person and a certificate issued by the qualified person under paragraph (1)(a) shall be deemed to be an inspection carried out and a certificate issued, respectively, under section 12 of the Act.
