(Saving and Transitional Provisions)
Regulations 2021
In exercise of the powers conferred by section 32(3) of the Protection from Harassment (Amendment) Act 2019, the Minister for Law makes the following Regulations:
Citation and commencement
1.  These Regulations are the Protection from Harassment (Amendment) Act 2019 (Saving and Transitional Provisions) Regulations 2021 and come into operation on 1 June 2021.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“Act” means the Protection from Harassment Act (Cap. 256A);
“old Act” means the Protection from Harassment Act as in force immediately before 1 June 2021.
Application of section 13A of Act
3.  Section 13A of the Act applies when a court makes an expedited protection order on or after 1 June 2021 under —
(a)section 13 of the Act; or
(b)pursuant to regulation 4, section 13 of the old Act.
Proceedings commenced before 1 June 2021
4.  Despite sections 13, 15 to 19, 20(8), 22, 28(2) and 29 of the Protection from Harassment (Amendment) Act 2019, the old Act continues to apply, with the necessary modifications, to the following:
(a)all Part 3 proceedings commenced in the District Court or a Magistrate’s Court before 1 June 2021;
(b)all civil proceedings under Part 3 of the Act arising from Part 3 proceedings mentioned in paragraph (a), including (but not limited to) the variation of an order made in such Part 3 proceedings.
Application of section 240(6) of Criminal Procedure Code
5.  Section 240(6) of the Criminal Procedure Code (Cap. 68) applies only to an accused who is charged with an offence under the Act (including a provision of the old Act) on or after 1 June 2021.
