Companies (Amendment No. 3) Regulations 2002

In exercise of the powers conferred by section 411 of the Companies Act, the Minister for Finance hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Companies (Amendment No. 3) Regulations 2002 and shall come into operation on 1st August 2002.

Deletion and substitution of regulation 43

2. Regulation 43 of the Companies Regulations (Rg 1) is deleted and the following regulation substituted therefor:

“Verification of proof

43. A declaration proving a debt may be made by the creditor himself or by some person authorised by or on behalf of the creditor.”.

Amendment of regulation 44

3. Regulation 44 of the Companies Regulations is amended by deleting paragraph (1) and substituting the following paragraph:

“(1) A declaration proving a debt shall be in accordance with Form 77 in the Second Schedule.”.

Amendment of First Schedule

4. The First Schedule to the Companies Regulations is amended by deleting the following items:

“

327 and Regulations 42 and 44

Declaration as to Proof of Debt General Form

327 and Regulation 52

Declaration as to Proof of Debt Employees’ Group Form

”.

and substituting the following item:

“

327 and Regulations 42, 44 and 52

Declaration as to Proof of Debt General Form

”.
