(Arrest Without Warrant —
Prescribed Circumstances)
Regulations 2021
In exercise of the powers conferred by section 20(1) of the Protection from Harassment Act, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Protection from Harassment (Arrest Without Warrant — Prescribed Circumstances) Regulations 2021 and come into operation on 1 June 2021.
Circumstances where police officer may arrest without warrant
2.—(1)  For the purpose of section 18(2) of the Act, a police officer may arrest without warrant any person that is reasonably suspected —
(a)to have committed an offence under section 10(1) of the Act by failing to comply with a provision that excludes the person from a shared residence or a specified part of a shared residence in an order mentioned in section 10(1) of the Act;
(b)to have committed an offence under section 10(1) of the Act by committing an act that also constitutes a specified offence against the victim or any related person of the victim specified in an order mentioned in section 10(1) of the Act; or
(c)to have committed, in one series of acts connected so as to form the same transaction —
(i)an offence under section 10(1) of the Act; and
(ii)one or more specified offences against the victim or any related person of the victim specified in an order mentioned in section 10(1) of the Act.
(2)  Whether the offences mentioned in paragraph (1)(c) are committed in one series of acts connected so as to form the same transaction is determined in the same manner as in section 134 of the Criminal Procedure Code (Cap. 68).
(3)  In this regulation, “specified offence” means —
(a)an offence in section 3, 4, 5, 6 or 7 of the Act or Chapter XVI or XXII of the Penal Code (Cap. 224); or
(b)an abetment of an offence mentioned in sub‑paragraph (a).
