(Marina Bay Sands Pte. Ltd. —
Exemption) Order 2022

In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:

Citation and period in force

1.—(1) This Order is the Active Mobility (Marina Bay Sands Pte. Ltd. — Exemption) Order 2022.

(2) This Order is in force for the period between 23 May 2022 and 23 November 2022 (both dates inclusive).

Definitions

2. In this Order —

“buggy” means an electronically operated vehicle that is intended for short distance transportation of any individual or thing;

“emergency” means an actual or imminent event that causes, or threatens to cause —

(a)	any harm or danger to the life, health or safety of any individual;
(b)	any destruction of, or damage to, any property; or
(c)	any harm or danger to the health or safety of the public;

“hours of darkness” means the time starting 7 p.m. and ending 7 a.m. the following day, both times inclusive;

“Marina Bay Sands Pte. Ltd.” means the company incorporated under the Companies Act 1967 as Marina Bay Sands Pte. Ltd. (UEN200507292R);

“specified event” means any event that is open to the public or a section of the public;

“specified footpath” means the footpath that is delineated by the black‑coloured line in the map set out in the Schedule;

“specified purpose” means any of the following purposes:

(a)	to transport any individual or thing in connection with a specified event;
(b)	to transport any individual or thing in connection with any maintenance works;
(c)	to carry out maintenance works;
(d)	to stand by in case of, or to respond to, an emergency.

Exemption for buggy drivers

3. Section 16(1)(b) of the Act does not apply to an individual who drives a buggy on the specified footpath for a specified purpose, under the following conditions:

(a)

the individual is authorised by Marina Bay Sands Pte. Ltd. to drive the buggy for the specified purpose;

(b)

the individual possesses a valid Class 3, 3A, 3C or 3CA driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27);

(c)

the individual, when driving the buggy —

(i)	does not exceed a speed of 10 km/h unless responding to an emergency; and
(ii)	gives way to other users of the specified footpath;

(d)

during hours of darkness, the individual keeps lit the headlamps and rear lamps of the buggy;

(e)

there is in force, at any time the buggy is used for the specified purpose, a policy of insurance insuring against any liability in respect of —

(i)	the death of or bodily injury sustained by any person (other than the driver or any passenger of the buggy); and
(ii)	any property damage suffered by any person (other than the driver or any passenger of the buggy),

caused by or arising out of the use of the buggy;

(f)

the risk under the policy of insurance mentioned in sub‑paragraph (e) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
