Environmental Pollution Control (Hazardous Substances) (Amendment) Regulations 2008

In exercise of the powers conferred by section 77(1) of the Environmental Protection and Management Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Environmental Pollution Control (Hazardous Substances) (Amendment) Regulations 2008 and shall come into operation on 31st January 2008.

Amendment of title

2. The Environmental Pollution Control (Hazardous Substances) Regulations (Rg 4) (referred to in these Regulations as the principal Regulations) are amended by deleting the words “ENVIRONMENTAL POLLUTION CONTROL” in the title and substituting the words “ENVIRONMENTAL PROTECTION AND MANAGEMENT”.

Amendment of regulation 1

3. Regulation 1 of the principal Regulations is amended by deleting the words “Environmental Pollution Control” and substituting the words “Environmental Protection and Management”.

Amendment of regulation 14

4. Regulation 14(1) of the principal Regulations is amended by deleting the words “21 years” in paragraph (b) and substituting the words “18 years”.

New regulation 23A

5. The principal Regulations are amended by inserting, immediately after regulation 23, the following regulation:

“Notification of loss or theft of hazardous substances

23A. In the event of discovery of any loss or theft of any hazardous substance, the consignor or owner of any consignment of a hazardous substance or any person authorised to transport or store hazardous substance shall directly or through his agent or employee —

(a)

immediately notify the loss or theft (as the case may be) to the police and the Director-General; and

(b)

as soon as practicable, furnish to the Director-General a detailed report in writing on the following:

(i)	the circumstances leading to the loss or theft (as the case may be); and
(ii)	the measures taken by him to prevent a recurrence of the loss or theft (as the case may be).”.

Amendment of regulation 24

6. Regulation 24 of the principal Regulations is amended by deleting the words “or 23” and substituting the words “, 23 or 23A”.

Deletion and substitution of Schedule

7. The Schedule to the principal Regulations is deleted and the following Schedule substituted therefor:
