Planning Act
(Chapter 232)
Planning (Changes in Use — Lodgment Authorisation) (Amendment No. 3) Notification 2003
In exercise of the powers conferred by section 21(6) of the Planning Act, the Minister for National Development hereby makes the following Notification:
Citation and commencement
1.  This Notification may be cited as the Planning (Changes in Use — Lodgment Authorisation) (Amendment No. 3) Notification 2003 and shall come into operation on 29th August 2003.
Amendment of paragraph 2
2.  Paragraph 2 of the Planning (Changes in Use — Lodgment Authorisation) Notification 2002 (G.N. No. S 382/2002) (referred to in this Notification as the principal Notification) is amended by inserting, immediately after the definition of “pedestrian link”, the following definition:
“ “People’s Association” means the People’s Association established under the People’s Association Act (Cap. 227);”.
Amendment of paragraph 4
3.  Paragraph 4 (1) of the principal Notification is amended —
(a)by deleting sub-paragraph (b) and substituting the following sub-paragraphs:
“(b)where the relevant premises are specified in the first column of items 1 to 5 in the First Schedule or in the first column of the Second Schedule, the floor area of the relevant premises is approved or authorised under the Act to be used for —
(i)a commercial use or purpose; or
(ii)any purpose in any Use Class or any use specified in the second column of items 1 to 5 in the First Schedule or the second column of the Second Schedule, as the case may be, in relation to the relevant premises;
(c)where the relevant premises are specified in the first column of item 6 in the First Schedule, the floor area of the relevant premises is approved or authorised under the Act to be used for —
(i)any purpose in Use Classes XII and XIII; or
(ii)any purpose in any Use Class or any use specified in the second column of item 6 in the First Schedule;”;
(b)by inserting, immediately after sub-paragraph (i), the following sub-paragraph:
“(ia)in the case of any building set out in Part VIII of the Fourth Schedule —
(i)where the person making the lodgment is not the People’s Association, the prior written approval of the People’s Association has been obtained for the change in use of the relevant premises prior to the lodgment of the plans and other documents under sub-paragraph (k); and
(ii)the total floor area of the part or parts of the building used for any of the purposes in any Use Class or any use specified in the second column of item 6 in the First Schedule does not exceed 20% of the total floor area of the building at the time of the lodgment of the plans and other documents under sub-paragraph (k);”;
(c)by inserting, immediately before the words “the floor area” in sub-paragraph (j), the words “in the case of any building set out in Parts I to VII of the Fourth Schedule,”;
(d)by deleting the words “or (j)” in sub-paragraph (k)(iii) (C) and substituting the words “, (ia) or (j)”;
(e)by inserting, immediately at the end of sub-paragraph (k)(vi), the word “and”;
(f)by deleting sub-paragraph (vii) of sub-paragraph (k) and substituting the following sub-paragraph:
“(vii)where the person making the lodgment is not the owner, a declaration to be signed by the person making the lodgment that the written consent of the owner of the relevant premises for the change in use has been obtained.”; and
(g)by deleting sub-paragraphs (viii) and (ix) of sub-paragraph (k).
Amendment of First Schedule
4.  The First Schedule to the principal Notification is amended —
(a)by deleting the words “The pedestrian link of any building in Part I of the Fourth Schedule and the first storey and any pedestrian link of any building in Part II of the Fourth Schedule” in the first column of item 2 and substituting the words “The pedestrian link of any building in Part I of the Fourth Schedule, the first storey and any pedestrian link of any building in Part II of the Fourth Schedule and the first storey and any basement of any building in Part IIA of the Fourth Schedule”;
(b)by deleting the words “Any building in Part III of the Fourth Schedule and the first storey of any building in Part VI of the Fourth Schedule” in the first column of item 4 and substituting the words “Any building in Part III of the Fourth Schedule, any building (excluding the first storey and any pedestrian link) in Part IIIA of the Fourth Schedule and the first storey of any building in Part VI of the Fourth Schedule”;
(c)by deleting the words “The first storey of any building in Part VII of the Fourth Schedule” in the first column of item 5 and substituting the words “The first storey and any pedestrian link of any building in Part IIIA of the Fourth Schedule and the first storey of any building in Part VII of the Fourth Schedule”; and
(d)by inserting, immediately after item 5, the following item:
