Education Service Incentive Payment Act
(Chapter 87B)
Education Service Incentive Payment (Connect Plan) (Amendment) Regulations 2008
In exercise of the powers conferred by section 3(1) of the Education Service Incentive Payment Act, the Minister for Education hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Education Service Incentive Payment (CONNECT Plan) (Amendment) Regulations 2008 and shall be deemed to have come into operation on 1st January 2008.
Amendment of regulation 2
2.  Regulation 2(1) of the Education Service Incentive Payment (CONNECT Plan) Regulations (Rg 1) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the definition of “contribution” and substituting the following definitions:
“ “Category A member” means a member who is —
(a)a public officer appointed to the Education Service who has attained the grade of —
(i)General Education Officer 1 (salary scale 1.1);
(ii)General Education Officer Grade 1A1;
(iii)General Education Officer Grade 1A2;
(iv)General Education Officer Grade 1A3; or
(v)Senior Education Officer (Timescale); or
(b)an aided school teacher on remuneration terms equivalent to those of a public officer referred to in paragraph (a);
“Category B member” means any member other than a Category A member;
“contribution”, in relation to any member, means a sum payable by the Government in respect of the member in accordance with regulation 8 or 16;”;
(b)by deleting the words “a person referred to in paragraph (a)” in paragraph (b) of the definition of “length of service” and substituting the words “those of a public officer appointed to the Education Service to any grade below Superscale grade (but not Grade 1.2 or 2.2 or its equivalent)”;
(c)by deleting the words “Grades 1.2 and 2.2” in paragraph (a) of the definition of “member” and substituting the words “Grade 1.2 or 2.2 or its equivalent”;
(d)by deleting the word “and” in paragraph (b) of the definition of “member”;
(e)by deleting the words “any member” in paragraph (b) of the definition of “member” and substituting the words “those of a public officer”;
(f)by deleting the words “means any member who, immediately before 1st January 2002,” in the definition of “serving member” and substituting the words “, as at any specified date, means any member who, immediately before that date,”; and
(g)by deleting the words “a person” in paragraph (b) of the definition of “serving member” and substituting the words “those of a public officer”.
Amendment of regulation 6
3.  Regulation 6(1) of the principal Regulations is amended —
(a)by deleting the word “or” at the end of sub-paragraph (a); and
(b)by deleting the full-stop at the end of sub-paragraph (b) and substituting the word “; or”, and by inserting immediately thereafter the following sub-paragraph:
(c)a member whose service has been interrupted for whatever reason is subsequently —
(i)appointed or reappointed to the Education Service to any grade below Superscale grade (but not Grade 1.2 or 2.2); or
(ii)employed or re-employed as an aided school teacher on remuneration terms equivalent to those of a public officer appointed to the Education Service to any grade below Superscale grade (but not Grade 1.2 or 2.2).”.
New regulation 7A
4.  The principal Regulations are amended by inserting, immediately after regulation 7, the following regulation:
Restoration of membership
7A.  Notwithstanding regulation 7, where a person who has ceased to be a member under regulation 7(1)(a), (b), (c), (d), (f), (g), (h) or (i) is subsequently —
(a)appointed or reappointed to the Education Service to any grade below Superscale grade (but not Grade 1.2 or 2.2); or
(b)employed or re-employed as an aided school teacher on remuneration terms equivalent to those of a public officer appointed to the Education Service to any grade below Superscale grade (but not Grade 1.2 or 2.2),
he shall be restored as a member, and his member’s account shall be reopened, with effect from the date of his appointment, reappointment, employment or re‐employment, as the case may be, and contributions may be credited to his member’s account from that date.”.
Amendment of regulation 8
5.  Regulation 8(2) of the principal Regulations is amended by inserting, immediately after the words “any year”, the words “from 1st January 2008”.
Amendment of regulation 9
6.  Regulation 9 of the principal Regulations is amended —
(a)by deleting “2002” in paragraph (1) and substituting “2008”;
(b)by inserting, immediately after the words “paragraph (1)” in paragraph (2), the words “or regulation 16”;
(c)by inserting, immediately after the words “any year” in paragraph (3), the words “from 1st January 2008”;
(d)by inserting, immediately after the words “this regulation” in paragraph (4), the words “or regulation 16”; and
(e)by inserting, immediately after the words “serving member” in paragraph (5), the words “as at 1st January 2002”.
Amendment of regulation 16
7.  Regulation 16 of the principal Regulations is amended —
(a)by deleting the words “every serving member” in paragraph (1) and substituting the words “every member who is a serving member as at 1st January 2002”;
(b)by deleting the words “the serving member” wherever they appear in paragraphs (1) and (2)(a) and substituting in each case the words “the member”;
(c)by deleting the words “any serving member” in paragraph (2) and substituting the words “any member who is a serving member as at 1st January 2002”; and
(d)by inserting, immediately after paragraph (2), the following paragraphs:
(3)  Subject to paragraphs (4) and (5), where, on 1st January 2008, the length of service of a serving member as at that date is not more than 40 years, a contribution may be credited to his member’s account in any year in which, on 1st January of that year, his length of service is more than 30 years but not more than 40 years, in respect of his qualifying service in that year.
(4)  Where, on 1st January 2008, the length of service of a serving member as at that date is not more than 30 years, there shall be credited to his member’s account a contribution of such amount in each such year as an Award Administrator shall, with the approval of the Minister, specify from time to time by notice in writing to the member.
(5)  Where, on 1st January 2008, the length of service of a serving member as at that date is more than 30 years but not more than 40 years, there shall be credited to his member’s account a contribution of such amount, being an amount of not less than —
(a)$3,200, if he is a Category A member; or
(b)$2,400, if he is a Category B member,
in each such year as an Award Administrator shall, with the approval of the Minister, specify from time to time by notice in writing to the member.
(6)  Where any contribution has been credited under paragraph (4) or (5) to the member’s account of a member who is a serving member as at 1st January 2008, the member may be granted an award out of those contributions of such amount in such year as an Award Administrator shall, with the approval of the Minister, specify from time to time by notice in writing to the member.”.
Deletion and substitution of First Schedule
8.  The First Schedule to the principal Regulations is deleted and the following Schedule substituted therefor:
