(INVEST Plan) (Amendment No. 2)
Regulations 2021
In exercise of the powers conferred by section 3 of the Home Affairs Uniformed Services Superannuation Act, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Home Affairs Uniformed Services (INVEST Plan) (Amendment No. 2) Regulations 2021 and come into operation on 1 July 2021.
Amendment of regulation 2
2.  Regulation 2(1) of the Home Affairs Uniformed Services (INVEST Plan) Regulations (Rg 2) (called in these Regulations the principal Regulations) is amended by deleting the words “55th anniversary” in the definition of “INVEST contribution cessation date” and substituting the words “56th anniversary”.
Amendment of regulation 10
3.  Regulation 10 of the principal Regulations is amended — 
(a)by deleting the words “paragraphs (2), (3), (4) and (5)” in paragraph (1) and substituting the words “these Regulations”;
(b)by deleting the words “at the age of 55 years” in paragraph (1) and substituting the words “on the 56th anniversary of his birth”;
(c)by deleting paragraphs (2) and (3) and substituting the following paragraphs:
(2)  A member may apply to the relevant authority to retire before the anniversary of his birth mentioned in paragraph (1), by specifying in his application the earlier date on which he wishes to retire, subject to the following restrictions:
(a)if the member is a junior officer, the earlier date must be on or after the 50th anniversary of his birth;
(b)if the member is a senior officer, the earlier date must be on or after the 55th anniversary of his birth.
(3)  Subject to paragraph (3A), the relevant authority has the discretion whether to permit an application to retire on an earlier date under paragraph (2).
(3A)  The relevant authority must permit the following applications under paragraph (2):
(a)an application by a junior officer who is a member immediately before 1 October 2013 to retire on a date mentioned in paragraph (2)(a);
(b)an application by a junior officer (not being a junior officer mentioned in sub‑paragraph (a)) who is a member immediately before 1 July 2021 to retire on a date on or after the 55th anniversary of his birth;
(c)an application by a senior officer who is a member immediately before 1 July 2021 to retire on a date on or after the 55th anniversary of his birth.”;
(d)by deleting the words “the member has attained the age of 55 years” in paragraph (4) and substituting the words “the 56th anniversary of his birth”;
(e)by deleting sub‑paragraph (a) of paragraph (4) and substituting the following sub‑paragraph:
(a)the relevant authority may make an offer for the member to retire on a later date (being no later than the 60th anniversary of his birth) specified in the offer; and”;
(f)by deleting the words “at the age” in paragraph (4)(b) and substituting the words “on that later date”;
(g)by deleting paragraph (5) and substituting the following paragraphs:
(5)  Where a later date applies to the retirement of a member under paragraph (4), the member may apply to the relevant authority to retire on a date specified in his application that is after the 56th anniversary of his birth but before that later date, and the relevant authority has the discretion whether to permit that application.
(5A)  Every application under paragraph (2) or (5) must be made before the date of retirement to be specified in the application.”;
(h)by deleting the semi‑colon at the end of the definition of “relevant authority” in paragraph (6) and substituting a full‑stop; and
(i)by deleting the definition of “relevant member” in paragraph (6).
Amendment of regulation 16
4.  Regulation 16(1) of the principal Regulations is amended by deleting the words “at such rate as the Minister may determine”.
Amendment of Second Schedule
5.  Paragraph 4A of the Second Schedule to the principal Regulations is amended by inserting, immediately after the last item of the Table, the following item:
