Films Act
(Chapter 107)
Films (Licensing and Classification) Regulations 2003
In exercise of the powers conferred by section 41 of the Films Act, the Minister for Information, Communications and the Arts hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Films (Licensing and Classification) Regulations 2003 and shall come into operation on 1st October 2003.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“distribution point” means a place from which films are distributed;
“exhibition point” means any place where films are exhibited and includes a cinema multiplex with one or more exhibition halls.
Fees
3.  The fee specified in the second column of the Schedule shall be payable for a licence granted under section 7 of the Act in respect of the matters set out in the first column thereof.
Waiver or reduction of fee
4.  The Licensing Officer may, in his discretion and subject to such conditions as he thinks fit, waive or reduce any fee payable under these Regulations in any particular case or class of cases.
Temporary distribution points
5.  In granting a licence under section 7 of the Act for a business for the temporary distribution of films, the Licensing Officer may impose as a condition of the licence that the temporary distribution of films may only be carried out at such designated distribution point or points as the Licensing Officer may specify.
Applicant to give cash deposit or bank guarantee
6.—(1)  The Licensing Officer may, before granting a licence under section 7 of the Act, require the applicant to give security, in the form of a cash deposit or bank guarantee, of not more than $20,000.
(2)  The Licensing Officer may, before granting a licence for any business for the temporary distribution of films, require the applicant to give security, in the form of a cash deposit or bank guarantee, of $5,000.
(3)  The Licensing Officer may, before granting a licence for any business for the temporary exhibition of films, require the applicant to give security, in the form of a cash deposit or bank guarantee, of $10,000.
Cash deposit or bank guarantee for due performance of certificate conditions
7.  The Board may, before issuing a certificate approving the exhibition of any film classified under section 16 of the Act as an “R(A)” or “NC-16” category film, require the owner of the film to give security, in the form of a cash deposit or bank guarantee, of $20,000 for the due performance of all or any of the conditions imposed in the certificate of the film.
Revocation
8.  The Films (Licensing) Regulations (Rg 1, 2003 Ed.) and the Films (Classification) (Fees) Regulations (Rg 3) are revoked.
