Environmental Public Health Act
(Chapter 95)
Environmental Public Health (General Waste Collection) (Amendment) Regulations 2002
In exercise of the powers conferred by section 113 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Environmental Public Health (General Waste Collection) (Amendment) Regulations 2002 and shall come into operation on 1st October 2002.
New regulations 7A and 7B
2.  The Environmental Public Health (General Waste Collection) Regulations (Rg 12) are amended by inserting, immediately after regulation 7, the following regulations:
Collection of waste for recycling permit
7A.—(1)  No licensee shall collect any waste for recycling from any premises unless the licensee is a holder of a permit issued under regulation 7B.
(2)  In this regulation, “premises” means any premises designated by the Director-General in any area under section 8(2) of the Act.
Application for permit for collection of waste for recycling
7B.—(1)  Every application for a permit to collect waste for recycling shall be made to the Director-General in such form as the Director-General may determine.
(2)  The Director-General may, if he thinks fit, issue a permit to any person who makes an application under paragraph (1).
(3)  A permit issued under paragraph (2) —
(a)shall specify the areas within which a permit holder may operate; and
(b)may contain such conditions on the permit holder as the Director-General may impose.”.
New regulation 17A
3.  The Environmental Public Health (General Waste Collection) Regulations are amended by inserting, immediately after regulation 17, the following regulation:
Disposal of waste for recycling
17A.  A holder of a permit issued under regulation 7B shall transport all waste collected by him for recycling to any recycling facility.”.
Transitional provision
4.  Notwithstanding anything in these Regulations, every company which, immediately before 1st October 2002, has been carrying on the business of collecting waste for recycling shall be entitled to continue to do so as if these Regulations had not been enacted —
(a)for a period of one month from that date; and
(b)if before the expiry of that period, the company applies for a permit under regulation 7B of the Environmental Public Health (General Waste Collection) Regulations, until the date on which its application is granted, refused or withdrawn.
