Immigration (Amendment No. 5) Regulations 2008
In exercise of the powers conferred by section 55(1) of the Immigration Act, the Minister for Home Affairs hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Immigration (Amendment No. 5) Regulations 2008 and shall come into operation on 25th September 2008.
Deletion and substitution of regulation 37
2.  Regulation 37 of the Immigration Regulations (Rg 1) is deleted and the following regulation substituted therefor:
Remission of fees
37.  The Controller may, in his discretion, remit or waive, wholly or in part, any fee payable under regulation 36.”.
Amendment of Third Schedule
3.  The Third Schedule to the Immigration Regulations is amended by deleting item 8 and substituting the following item:
8. Visit pass —
regulation 12(8)
 
(a) Issue of a visit pass valid for less than 90 days
 
No fee
 
 
(b) Issue of a visit pass valid for 90 days or more
 
$60
 
 
(c) Subject to paragraph (d), extension of the validity of a visit pass by less than 90 days
 
No fee
 
 
(d) Extension of the validity of a visit pass by less than 90 days, where the aggregate of —
 
 
 
 
(i) the period of that extension; and
 
 
 
 
(ii) the period or periods of extension of the pass, for which no fee was payable under paragraph (c), immediately preceding that extension,
 
 
 
 
is 90 days or more
 
$40
 
 
(e) Extension of the validity of a visit pass by 90 days or more
 
$60
”.
