(Composition of Offences)
(Amendment) Regulations 2023
In exercise of the powers conferred by section 77 of the Environmental Protection and Management Act 1999, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations are the Environmental Protection and Management (Composition of Offences) (Amendment) Regulations 2023 and, except for regulation 2(b), come into operation on 10 February 2023.
(2)  Regulation 2(b) is deemed to have come into operation on 31 December 2021.
Amendment of regulation 2
2.  In regulation 2 of the Environmental Protection and Management (Composition of Offences) Regulations (Rg 7) —
(a)replace “The following offences may be compounded by the Director‑General or any authorised officer in accordance with section 72(1) of the Act” with “Each of the following offences is prescribed as a compoundable offence that may be compounded in accordance with section 72 of the Act”;
(b)in paragraph (a), replace “33(1A)” with “33(2)”;
(c)in paragraph (a), after “35(6),”, insert “40C(2), 40D(3), 40G(6), 40I(3), 40J(9) (other than a continuing offence), 40L(4), 40N(5), 40O(3), 40P(2) (other than a continuing offence), 40Q(2) (other than a continuing offence), 40R(9), 40S(3), 40U(5) (other than a continuing offence), 40V(4), 40W(2), 40X,”; and
(d)after paragraph (d), insert —
(da)any offence under regulation 8(2) or 9(4) of the Environmental Protection and Management (Regulated Goods and Registered Suppliers) Regulations 2022 (G.N. No. S 274/2022);”.
