Environmental Public Health Act
(Chapter 95)
Environmental Public Health (Public Cleansing) (Amendment No. 2) Regulations 2006
In exercise of the powers conferred by section 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Environmental Public Health (Public Cleansing) (Amendment No. 2) Regulations 2006 and shall come into operation on 28th August 2006.
New regulation 6A
2.  The Environmental Public Health (Public Cleansing) Regulations (Rg 3) are amended by inserting, immediately after regulation 6, the following regulation:
Prohibition on open burning, etc.
6A.—(1)  Subject to paragraph (2), no person shall carry out, or cause or permit, any open burning of refuse or waste in or at any place.
(2)  Paragraph (1) shall not apply —
(a)to any campfire or barbecue;
(b)in relation to any practice of a religious nature; or
(c)in such other circumstances as the Director-General may permit.
(3)  In this regulation, unless the context otherwise requires, “open burning” means any fire, combustion or smouldering that occurs in the open, and includes the burning of refuse or waste in any container or receptacle which results in the emission into the air of any air impurity within the meaning of the Environmental Pollution Control Act (Cap. 94A).”.
