Education Endowment Scheme Act
(Chapter 87A)
Education Endowment Scheme (Good Progress Awards) (Amendment) Regulations 2004
In exercise of the powers conferred by sections 6 (1)(d) and 24 (a) of the Education Endowment Scheme Act, the Minister for Education hereby makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations may be cited as the Education Endowment Scheme (Good Progress Awards) (Amendment) Regulations 2004 and shall, with the exception of regulation 2(c), be deemed to have come into operation on 1st January 2004.
(2)  Regulation 2(c) shall be deemed to have come into operation on 18th March 2004.
Amendment of regulation 2
2.  Regulation 2 of the Education Endowment Scheme (Good Progress Awards) Regulations (Rg 7) (referred to in these Regulations as the principal Regulations) is amended —
(a)by inserting, immediately after the definition of “independent school”, the following definition:
“ “integrated programme” means an education programme which provides an integrated secondary and pre-university education;”;
(b)by deleting the words “in a secondary school,” in paragraph (b) of the definition of “stream” and substituting the words “in a secondary school who is not enrolled in an integrated programme,”; and
(c)by deleting the definition of “stream” and substituting the following definition:
“ “stream”, in relation to —
(a)a pupil in a primary school; or
(b)a pupil in a secondary school who is not enrolled in an integrated programme,
means any classification of pupils of his standard in the school in which he is enrolled according to such academic criteria as the Minister may determine;”.
Amendment of regulation 4
3.  Regulation 4 (1) of the principal Regulations is amended by deleting sub-paragraphs (c) and (d) and substituting the following sub-paragraphs:
(c)$150, if awarded to any pupil undergoing secondary education —
(i)in a secondary school; or
(ii)in a junior college as part of an integrated programme;
(d)$200, if awarded to any pupil undergoing pre-university education in a junior college; and”.
Amendment of regulation 5
4.  Regulation 5 of the principal Regulations is amended —
(a)by deleting the words “of a primary or secondary school” in paragraph (1)(b) and substituting the words “undergoing primary or secondary education”;
(b)by deleting sub-paragraph (c) of paragraph (1) and substituting the following sub-paragraph:
(c)in the case of a pupil undergoing pre-university education —
(i)has obtained the qualifying gain in rank;
(ii)has passed the relevant examinations conducted in that year for such pre-university courses as may be specified by the Ministry; and
(iii)is not in that year the recipient of the Edusave Merit Bursary established under the Education Endowment Scheme (Edusave Merit Bursaries) Regulations or any scholarship awarded by the Ministry to pupils undergoing pre-university education; or”;
(c)by inserting, immediately after paragraph (2), the following paragraph:
(2A)  Notwithstanding paragraph (1), a pupil —
(a)who is enrolled in an integrated programme in a secondary school or junior college; and
(b)who is undergoing secondary education in that secondary school or junior college,
will not be eligible for a Good Progress Award in the first year that he is enrolled in that integrated programme, unless the principal of that secondary school or junior college determines, in accordance with such guidelines as the Ministry may issue, that there is an appropriate basis for comparing the pupil’s ranking in the relevant examinations conducted by that secondary school or junior college in that year and the pupil’s ranking in the relevant examinations taken by the pupil in the previous year.”;
(d)by deleting paragraphs (4) and (5) and substituting the following paragraphs:
(4)  Notwithstanding paragraph (1)(b)(i), the principal of every primary school shall determine the percentage of pupils in each stream in each standard enrolled in the primary school who shall be awarded the awards specified in regulation 4 (1)(a) or (b), as the case may be.
(5)  Notwithstanding paragraph (1)(b)(i), the principal of every secondary school shall determine, in respect of pupils in the secondary school who are not enrolled in any integrated programme, the percentage of such pupils in each stream in each standard enrolled in the secondary school who shall be awarded the awards specified in regulation 4 (1)(c)(i).
(5A)  Notwithstanding paragraph (1)(b)(i), the principal of every secondary school or junior college providing secondary education as part of an integrated programme shall determine, in respect of pupils undergoing secondary education in the secondary school or junior college who are enrolled in the integrated programme, the percentage of such pupils in each standard in the integrated programme who shall be awarded the awards specified in regulation 4 (1)(c)(i) or (ii), as the case may be.
(5B)  Notwithstanding paragraph (1)(c)(i), the principal of every junior college that does not provide an integrated programme shall determine the percentage of pupils enrolled in each course in each level in the junior college who shall be awarded the awards specified in regulation 4 (1)(d).
(5C)  Notwithstanding paragraph (1)(c)(i), the principal of every junior college that provides an integrated programme, whether on its own or jointly with any secondary school, shall determine —
(a)in respect of pupils undergoing pre-university education who are in the first year of enrolment in the integrated programme, the percentage of such pupils enrolled in each course in each level in the junior college who shall be awarded the awards specified in regulation 4 (1)(d); and
(b)in respect of pupils undergoing pre-university education who are in the second or any subsequent year of enrolment in the integrated programme, the percentage of such pupils enrolled in each course in each level in the junior college who shall be awarded the awards specified in regulation 4 (1)(d).”; and
(e)by deleting the definition of “qualifying gain in rank” in paragraph (7) and substituting the following definition:
“ “qualifying gain in rank” means the lowest gain in rank which is obtained —
(a)in the case of a pupil undergoing primary education, by any pupil standing among the 10% of all pupils in the same stream and standard in his primary school who have obtained the highest gains in rank in that year;
(b)in the case of a pupil undergoing secondary education who is not enrolled in any integrated programme, by any pupil standing among the 10% of all pupils in the same stream and standard in his secondary school —
(i)who are not enrolled in any integrated programme; and
(ii)who have obtained the highest gains in rank in that year;
(c)in the case of a pupil undergoing secondary education who is enrolled in an integrated programme in a secondary school or junior college, by any pupil standing among the 10% of all pupils in the same standard in that secondary school or junior college —
(i)who are enrolled in the integrated programme; and
(ii)who have obtained the highest gains in rank in that year;
(d)in the case of a pupil undergoing pre-university education in a junior college that does not provide an integrated programme, by any pupil standing among the 10% of all pupils reading the same course at the same level in the junior college who have obtained the highest gains in rank in that year;
(e)in the case of a pupil undergoing pre-university education in a junior college that provides an integrated programme, whether on its own or jointly with any secondary school, who is in the first year of enrolment in the integrated programme, by any pupil standing among the 10% of all pupils reading the same course at the same level in the junior college —
(i)who are in the first year of enrolment in the integrated programme; and
(ii)who have obtained the highest gains in rank in that year;
(f)in the case of a pupil undergoing pre-university education in a junior college that provides an integrated programme, whether on its own or jointly with any secondary school, who is in the second or any subsequent year of enrolment in the integrated programme, by any pupil standing among the 10% of all pupils reading the same course at the same level in the junior college —
(i)who are in the second or any subsequent year of enrolment in the integrated programme; and
(ii)who have obtained the highest gains in rank in that year; or
(g)in the case of a full-time pupil of a training institute, by any pupil standing among the 10% of all pupils reading the same course at the same level in the training institute who have obtained the highest gains in rank in that year,
as the case may be.”.
