Home Affairs Uniformed Services Superannuation Act

Home Affairs Uniformed Services (Invest Fund) (Amendment) Regulations 2003
In exercise of the powers conferred by section 24 of the Home Affairs Uniformed Services Superannuation Act, the Minister for Home Affairs hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Home Affairs Uniformed Services (INVEST Fund) (Amendment) Regulations 2003 and shall come into operation on 30th January 2003.
Amendment of regulation 2
2.  Regulation 2 of the Home Affairs Uniformed Services (INVEST Fund) Regulations 2001 (G.N. No. S 485/2001) (referred to in these Regulations as the principal Regulations) is amended —
(a)by inserting, immediately after the definition of “Contribution Account”, the following definitions:
“ “CPIB junior officer” means a member of the Scheme appointed to the Corrupt Practices Investigation Service (Junior) Scheme of Service;
“CPIB officer” means a CPIB junior officer or a CPIB senior officer;
“CPIB senior officer” means a member of the Scheme appointed to the Corrupt Practices Investigation Service (Senior) Scheme of Service;”;
(b)by deleting the words “who was a former police officer below the rank of Inspector” in paragraph (b) of the definition of “junior officer”;
(c)by inserting, immediately after the definition of “Provisional Account”, the following definition:
“ “Scheme” means the occupational superannuation scheme established under the Prevention of Corruption Act (Cap. 241) for the benefit of CPIB officers who are its members;”; and
(d)by inserting, immediately after the words “Ministry of Home Affairs” in the definition of “Voted Funds”, the words “or the Prime Minister’s Office”.
Amendment of regulation 3
3.  Regulation 3 (1) of the principal Regulations is amended —
(a)by inserting, immediately after sub-paragraph (e), the following sub-paragraph:
(ea)the Director of the Corrupt Practices Investigation Bureau;”;
(b)by deleting the word “and” at the end of sub-paragraph (g);
(c)by inserting, immediately after sub-paragraph (g), the following sub-paragraph:
(ga)the Director, Human Resource Division, Ministry of Home Affairs;”; and
(d)by deleting “7” in sub-paragraph (h) and substituting “5”.
Amendment of regulation 6
4.  Regulation 6 (3) of the principal Regulations is amended by inserting, immediately after the words “INVEST Plan”, the words “or the Scheme”.
Amendment of regulation 9
5.  Regulation 9 of the principal Regulations is amended —
(a)by deleting paragraphs (a) and (b) and substituting the following paragraphs:
(a) any gratuity, allowance, compensation, injury award or other benefit in accordance with the INVEST Plan or the Scheme;
(b) any allowance, subsidy or other benefit (including medical benefits) to former members of the INVEST Plan or the Scheme as specified in the Home Affairs Uniformed Services (INVEST Plan) Regulations 2001 (G.N. No. S 486/2001) or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003), as the case may be;”; and
(b)by inserting, immediately after the word “Regulations” in the penultimate line of paragraph (c), the words “2001 or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003”.
Amendment of regulation 10
6.  Regulation 10 of the principal Regulations is amended —
(a)by inserting, immediately after the word “disablement” in paragraph (a), the words “under the INVEST Plan or the Scheme, as the case may be”;
(b)by deleting the word “; and” at the end of paragraph (d)(i) and substituting the words “or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003), as the case may be;”;
(c)by inserting, at the end of sub-paragraph (ii) of paragraph (d), the word “and”, and by inserting immediately thereafter the following sub-paragraph:
(iii)such moneys in the Capital Forfeiture Account as may be transferred in accordance with regulation 12 (2);”;
(d)by inserting, immediately after the words “Regulations 2001” in paragraph (e), the words “or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003, as the case may be”; and
(e)by deleting the words “regulation 23 of the Home Affairs Uniformed Services (INVEST Plan) Regulations 2001” in the 4th, penultimate and last lines of paragraph (f) and substituting the words “the Home Affairs Uniformed Services (INVEST Plan) Regulations 2001 or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003, as the case may be”.
Amendment of regulation 11
7.  Regulation 11 of the principal Regulations is amended —
(a)by deleting paragraph (1) and substituting the following paragraph:
(1)  The Board shall also maintain the following subsidiary accounts within the Contribution Account in respect of each member of the INVEST Plan and the Scheme:
(a)in the case of members of the INVEST Plan —
(i)a Retirement Account for a senior officer other than a senior police officer;
(ii)a Retirement Account and a Central Provident Fund Top-Up Account for a senior police officer; or
(iii)a Retirement Account and a Retention Account for a junior officer; or
(b)in the case of members of the Scheme —
(i)a Retirement Account and a Central Provident Fund Top-Up Account for a CPIB senior officer; or
(ii)a Retirement Account and a Retention Account for a CPIB junior officer.”;
(b)by deleting the words “INVEST Fund” in the 2nd line of paragraph (2) and substituting the words “INVEST Plan or the Scheme, as the case may be”;
(c)by inserting, immediately after the words “(G.N. No. S 486/2001)” in paragraph (2)(a), the words “or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003), as the case may be”; and
(d)by inserting, immediately after the words “INVEST Plan” in paragraph (3), the words “or the Scheme, as the case may be,”.
Amendment of regulation 12
8.  The principal Regulations are amended by renumbering regulation 12 as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  The Board may at any time transfer any moneys in the Capital Forfeiture Account to the Stabilisation Account.”.
Amendment of regulation 13
9.  Regulation 13 of the principal Regulations is amended —
(a)by deleting sub-paragraph (c) of paragraph (2) and substituting the following sub-paragraph:
(c)all losses, whether sustained from realisation of such investment or from unrealised losses of investment;”; and
(b)by inserting, immediately after the words “(G.N. No. S 486/2001)” in paragraph (2)(d) and in the penultimate line of paragraph (3), the words “or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003), as the case may be”.
Amendment of regulation 15
10.  Regulation 15 (2) of the principal Regulations is amended by inserting, immediately after the words “Regulations 2001”, the words “or the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003), as the case may be”.
New regulation 15A
11.  The principal Regulations are amended by inserting, immediately after regulation 15, the following regulation:
Deficiency in INVEST Fund
15A.  Any deficiency, including losses from the realisation of investments or unrealised losses on the INVEST Fund which may from time to time arise shall be made good out of the amount standing to the credit of the Contribution Account, Stabilisation Account, Compensation Account, Capital Forfeiture Account, Provisional Account or Post-Retirement Medical Account.”.
Amendment of regulation 19
12.  Regulation 19 of the principal Regulations is amended by inserting, immediately after the words “INVEST Plan” in the 2nd line, the words “and the Scheme”.
Amendment of regulation 20
13.  Regulation 20 of the principal Regulations is amended —
(a)by inserting, immediately after the word “member” in paragraph (1), the words “of the INVEST Plan or the Scheme, as the case may be”;
(b)by inserting, immediately after the word “member” in the 1st line of paragraph (2), the words “of the INVEST Plan or the Scheme, as the case may be”;
(c)by inserting, immediately after the word “member” in the 2nd line of paragraph (2), the word “concerned”; and
(d)by inserting, immediately after paragraph (2), the following paragraph:
(3)  In paragraph (2), “Minister” —
(a)in relation to a member of the INVEST Plan, means the Minister for Home Affairs; and
(b)in relation to a member of the Scheme, means the Prime Minister.”.
