Private Investigation and Security Agencies (Amendment) Regulations 2003

In exercise of the powers conferred by section 27 of the Private Investigation and Security Agencies Act, the Minister for Home Affairs hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Private Investigation and Security Agencies (Amendment) Regulations 2003 and shall come into operation on 29th November 2003.

Deletion and substitution of regulation 2

2. Regulation 2 of the Private Investigation and Security Agencies Regulations (Rg 1) (referred to in these Regulations as the principal Regulations) is deleted and the following regulation substituted therefor:

“Application for licence

2.—(1) Subject to paragraph (2) —

(a)	every application for a private investigator’s licence or a security guard agency’s licence shall be made using the electronic service provided by the licensing officer; and
(b)	the form prescribed for such an application shall be the electronic form provided for the electronic service at http://www.spf.gov.sg/licence/.

(2) In the event of a malfunction or failure of the electronic service, the application shall be made in Form A set out in the Schedule.”.

Deletion and substitution of regulations 11, 12 and 13

3. Regulations 11, 12 and 13 of the principal Regulations are deleted and the following regulations substituted therefor:

“Annual returns

11.—(1) A licensee shall submit to the licensing officer an annual return of all persons employed by him to assist him in the work of a private investigator or as a security guard in his business.

(2) The annual return shall be submitted at such time as the licensing officer may direct.

(3) Subject to paragraph (4) —

(a)	the annual return shall be submitted using the electronic service provided by the licensing officer; and
(b)	the form prescribed for the annual return shall be the electronic form provided for the electronic service at http://www.spf.gov.sg/licence/.

(4) In the event of a malfunction or failure of the electronic service, the annual return shall be submitted in Form G set out in the Schedule.

Application for approval to employ assistant or security guard

12.—(1) A licensee who wishes to employ any person to assist him in the work of a private investigator or as a security guard —

(a)	shall apply to the licensing officer for approval to employ that person; and
(b)	shall not employ that person before the licensing officer has given him such approval.

(2) Subject to paragraph (3) —

(a)	an application under paragraph (1) shall be made using the electronic service provided by the licensing officer; and
(b)	the form prescribed for the application shall be the electronic form provided for the electronic service at http://www.spf.gov.sg/licence/.

(3) In the event of a malfunction or failure of the electronic service, an application under paragraph (1) shall be made in Form H set out in the Schedule.

Assistant ceasing to be employed

13.—(1) Subject to paragraph (2), when a person employed by a licensee to assist him in the work of a private investigator or as a security guard ceases to be so employed, the licensee shall, within 14 days of the cessation of employment, notify the licensing officer of this fact using the electronic service provided by the licensing officer.

(2) In the event of a malfunction or failure of the electronic service, a notification under paragraph (1) shall be submitted to the licensing officer in such form and manner as the licensing officer may determine.”.

Amendment of regulation 14

4. Regulation 14 of the principal Regulations is amended by deleting paragraph (2) and substituting the following paragraphs:

“(2) The register shall contain the following personal particulars of each person employed by the licensee to assist him in the work of a private investigator or as a security guard:

(a)	name in English and, if applicable, in Chinese characters;
(b)	NRIC Number (with official reference), where the person is a citizen or permanent resident of Singapore;
(c)	Foreign Identification Number, where the person is a foreigner;
(d)	race;
(e)	sex;
(f)	date of birth;
(g)	citizenship;
(h)	home address;
(i)	date of commencement of employment;
(j)	date of cessation of employment, where the person has ceased to be employed by the licensee; and
(k)	serial number of identification paper issued to the person by the licensee under section 15 of the Act.

(3) The register may be kept in the form of an electronic record.”.

Amendment of regulation 16

5. Regulation 16 of the principal Regulations is amended —

(a)

by deleting the words “within 14 days of the change, make a written application” in paragraph (1) and substituting the words “within 7 days of the change, apply”; and

(b)

by inserting, immediately after paragraph (2), the following paragraphs:

“(3) Subject to paragraph (4), an application under paragraph (1) shall be made using the electronic service provided by the licensing officer.

(4) In the event of a malfunction or failure of the electronic service, an application under paragraph (1) shall be made in such form and manner as the licensing officer may determine.”.

New regulation 16A

6. The principal Regulations are amended by inserting, immediately after regulation 16, the following regulation:

“Change of directors

16A.—(1) Subject to paragraph (2), where a licensee is a company, the licensee shall, within 7 days of any change in the particulars of its directors, notify the licensing officer of the change using the electronic service provided by the licensing officer.

Amendment of regulation 18

7. Regulation 18 of the principal Regulations is amended —

(a)

by deleting the word “informed” in paragraph (1) and substituting the word “notified”;

(b)

by inserting, immediately after paragraph (2), the following paragraphs:

“(3) Subject to paragraph (4), a notification under paragraph (1) shall be submitted using the electronic service provided by the licensing officer.

(4) In the event of a malfunction or failure of the electronic service, a notification under paragraph (1) shall be submitted in such form and manner as the licensing officer may determine.”; and

(c)

by deleting the word “informed” in the regulation heading and substituting the word “notified”.

Amendment of Schedule

8. The Schedule to the principal Regulations is amended —

(a)

by deleting Forms A, B and C and substituting the following Forms:
