Telecommunications (Exemption from Telecom Competition Code) Notification 2003
In exercise of the powers conferred by section 26(3) of the Telecommunications Act, the Info-communications Development Authority of Singapore hereby makes the following Notification:
Citation and commencement
1.  This Notification may be cited as the Telecommunications (Exemption from Telecom Competition Code) Notification 2003 and shall come into operation on 26th November 2003.
Exemption
2.—(1)  Singapore Telecommunications Ltd (referred to in this Notification as SingTel) is exempted from the following provisions of the Code of Practice for Competition in the Provision of Telecommunication Services (G.N. No. S 412/2000):
(a)subsection 3.3.4 (Duty to File and Provide Service Pursuant to Tariffs), in relation to the Retail International Telephone Services specified in sub-paragraph (2);
(b)subsection 5.8.3 (Duty to Tariff and Make Wholesale Telecommunication Services Generally Available), in relation to the Wholesale International Telephone Services specified in sub-paragraph (3); and
(c)subsections 7.2.1 to 7.2.2.2 (Pricing Abuses and Other Abuses), to the extent that these provisions apply only to Dominant Licensees, in relation to the Wholesale International Telephone Services specified in sub-paragraph (3).
(2)  The Retail International Telephone Services referred to in sub-paragraph (1)(a) are —
(a)BC 013;
(b)Corporate Switched Telecommunications Network;
(c)FaxPlus;
(d)IDD 001;
(e)International Calling Cards;
(f)International Toll Free Services;
(g)Operator Assisted Services;
(h)Overseas Collect Call;
(i)Overseas Paid 800;
(j)Prepaid Calling Cards;
(k)STD 020;
(l)Voice Virtual Private Network Service;
(m)v019;
(n)World Conference; and
(o)such other service as may be confirmed by the Authority to be a Retail International Telephone Service under paragraph 3.
(3)  The Wholesale International Telephone Services referred to in sub-paragraph (1)(b) and (c) are —
(a)Wholesale Voice Basic Services;
(b)Wholesale Voice Silver Services;
(c)Wholesale Voice Gold Services; and
(d)such other service as may be confirmed by the Authority to be a Wholesale International Telephone Service under paragraph 3.
Procedure for confirmation
3.—(1)  For the purposes of paragraph 2(2)(o) and (3)(d), SingTel shall notify the Authority, in writing, that it intends to offer the new International Telephone Service, and include in such notice —
(a)a clear and complete description of the new service; and
(b)an explanation as to why the new service constitutes a Retail International Telephone Service or a Wholesale International Telephone Service, as the case may be.
(2)  Upon considering the notice under sub-paragraph (1), the Authority shall confirm, in writing, whether the new service constitutes a Retail International Telephone Service, a Wholesale International Telephone Service, or otherwise.
