Cinematograph Film Hire Duty
(Amendment) Rules 2018

In exercise of the powers conferred by section 23(1) of the Cinematograph Film Hire Duty Act, the Minister for Finance makes the following Rules:

Citation and commencement

1. These Rules are the Cinematograph Film Hire Duty (Amendment) Rules 2018 and are deemed to have come into operation on 3 January 2016.

Amendment of rule 6

2. Rule 6 of the Cinematograph Film Hire Duty Rules (R 1) is amended —

(a)

by deleting paragraphs (a) and (b) and substituting the following paragraphs:

“(a)

if the applicant is a person registered under the Business Names Registration Act 2014 (Act 29 of 2014) —

(i)

the applicant’s business name;

(ii)

the applicant’s registration number and registration date;

(iii)

where the applicant is an individual proprietor, the full name, residential address and identity card number of the applicant or if the applicant is not registered under the National Registration Act (Cap. 201), the passport number of the applicant; and

(iv)

where the applicant is a partnership —

(A)	the full name, residential address and identity card number of every partner who is an individual or if the individual is not registered under the National Registration Act, the passport number of the individual; and
(B)	the name, registered office, registration number and registration date of every partner that is a corporation;

(b)

if the applicant is a company incorporated under the Companies Act (Cap. 50) —

(i)	the applicant’s company name;
(ii)	the applicant’s registration number and registration date; and
(iii)	the full name, residential address and identity card number of the individual representative who makes the application on behalf of the applicant or if the individual representative is not registered under the National Registration Act, the passport number of the individual representative;”; and

(b)

by renumbering the rule as paragraph (1) of that rule, and by inserting immediately thereafter the following paragraph:

“(2) In this rule —

“registration date” means —

(a)	in the case of a company incorporated under the Companies Act, the date of incorporation under that Act;
(b)	in the case of a foreign company registered under the Companies Act, the date of registration under that Act; and
(c)	in the case of a person registered under the Business Names Registration Act 2014, the Limited Liability Partnerships Act (Cap. 163A) or the Limited Partnerships Act (Cap. 163B), as the case may be, the date of registration under that Act;

“registration number” means —

(a)

in the case of a company incorporated under the Companies Act, the number assigned to the company upon incorporation under that Act;

(b)

in the case of a corporation incorporated outside Singapore —

(i)	if it is registered as a foreign company under the Companies Act, the number assigned to the company upon registration under that Act; and
(ii)	if it is not registered as a foreign company under the Companies Act, the number assigned to the corporation under the law of its place of incorporation;

(c)

in the case of a person registered under the Business Names Registration Act 2014, the number assigned to the person upon registration under that Act;

(d)

in the case of a limited liability partnership registered under the Limited Liability Partnerships Act, the number assigned to the limited liability partnership upon registration under that Act; and

(e)

in the case of a limited partnership registered under the Limited Partnerships Act, the number assigned to the limited partnership upon registration under that Act.”.

Amendment of rule 12

3. Rule 12 of the Cinematograph Film Hire Duty Rules is amended by deleting “, 6”.
